Supreme Court Of Appeals Overturns Convictions

WEST VIRGINIA....
Nathaniel Todd Barnett and his brother, Phillip Barnett, met a $100,000 property bond and were released to home confinement Wednesday, pending a trial tentatively set for December 7th. The state Supreme Court of Appeals overturned convictions granting the brothers a new trial after being convicted August 2008 for the August 5, 2002, strangulation of 21 year old Deanna Crawford. Brian Emerson Dement pleaded guilty in October 2007 only to recant his confession two days later. Dement's words and explanation of the event had led to second-degree murder convictions for himself, the brothers and a fourth suspect, Justin Keith Black. The state Supreme Court overturned the Barnetts' conviction last month when it ruled then-Circuit Judge John Cummings erred when he denied the defense a chance to play two recordings of Dement's jailhouse comments, which cleared all of those charged.
