Chief Justice of West Virginia State Supreme Court Recuses Himself From Case.
West Virginia Supreme Court Justice "Spike" Maynard announced late last week that he will recuse himself from a case involving Massey Energy.
Photos were released last week showing the Mingo County native posing in a picture with Massey CEO Don Blankenship while vacationing in Europe in 2006.
Both men contend that they were vacationing separately.
Maynard voted in a 3-2 majority ruling that overturned a $ 76.3 million verdict against Massey in a contract dispute with another mining company.
The high court has been asked to review the decision.
Maynard will be replaced in the case by Hampshire County Circuit Judge Donald Cookman.
