WV State Supreme Court Overturns $ 50 Million Dollar Suit Against Massey.
The West Virginia Supreme Court by a vote of 3-2 overturned an August 2002 Boone County jury verdict worth $50 million dollars in damages against Massey Energy and CEO Don Blankenship.
A Boone County jury originally found Massey guilty of damaging the economic interest of Harman Mining, a Virginia mining operation owned by Hugh Caperton causing it to go bankrupt.
Justice Robin Davis, who wrote the majority opinion, concluded that a six million dollar verdict that Harman Mining received in Virginia was sufficient and that the suit filed in WV should have never been filed.
