Bell County Seeking Permit For Clean Coal Power Plant
KENTUCKY....
Bell County officials say they now have the ten million dollars needed to apply for a permit to build a clean coal power plant at a site off of highway 1-19 in Bell County. Sky Energy leaders intend to undertake the full development of the project. For the first few years, officials say the project will require more than 15 hundred jobs. Officials hope to break ground in less than two years on the 600 mega watt power plant that will use 2 million tons of local coal every year.
Audit Reveals Overpayment For Prison Food
KENTUCKY....
Philadelphia-based Aramark Correctional Services serves three meals each day at Kentucky's 13 state prisons. Thursday, State Auditor Crit Luallen released an audit of the Department of Corrections' $12 million food service contract with Aramark which identified more than $36,000 in overpayments made by Department of Corrections to Armark due to billing errors and noncompliance with contract provisions and said the total overpayments could exceed $130,000. The audit found that in most cases billing errors and food production problems favored Aramark rather than the state. Due to poor documentation, it could not be determined whether Aramark consistently followed approved recipes, used the proper quantity of ingredients, and met food safety standards regarding food temperatures or use of leftovers. Aramark received almost $148,000 in inmate-grown food for nearly no cost, which is not compliant with the contract.

Oldest NFL And Former UK Football Player Dies

Ralph Kercheval, the first All-Southeastern Conference football player at the University of Kentucky, has passed away in Lexington at the age of 98. Kercheval, who graduated from Henry Clay High School, also participated in basketball and track at UK, but football was his best sport. He was a football letterman from 1931-33 and was the first Wildcat to earn first-team All-SEC honors during the inaugural season of the league in 1933.
Kercheval played quarterback, defensive back and kicker for the Wildcats and is best known for his exploits as a punter. He still holds SEC records for most punts in a season (101), most punting yards in a season (4,413) and his 52.0-yard punting average against Cincinnati in 1933 is still the single-game league record (min. 10 punts). During his UK career, he punted 234 times for 9,749 yards, an average of 44.8 yards per punt.
Following his time at UK, Kercheval played seven years (1934-40) in the National Football League for the Brooklyn Dodgers as a running back and punter. At the time of his death, he was known as the oldest living player in the NFL.

UK Assistant Dean Pleads Not Guilty

KENTUCKY....
Ray Dowd, 49, an assistant dean at the University of Kentucky, had a not guilty plea entered by his attorney Thursday after being arrested Saturday afternoon on charges of criminal trespassing and giving a false name and address to a police officer. A woman living at the Springhouse Apartments reported a man suspiciously walking around the complex Saturday and said the same man had exposed himself to her weeks earlier. When police arrived they quickly found Dowd, whm police say gave them a fake name and address. Dowd was released on bond on Sunday.
Activists File Notice Of Intent Against Kentucky Mines

Environmental activists with Waterkeeper Alliance and Appalachian Voices say they have found 20,000 instances of violations of the federal Clean Water Act at three eastern Kentucky mines over a two-year period. The groups have filed a notice of intent to sue Frasure Creek Mining and ICG of Knott County and Hazard. The groups say they found numerous instances of forms signed and dated by supervisors before testing was conducted, forms copied and pasted from one quarter to the next, and testing dates scratched out and rewritten to appear compliant. Each of the 20,000 violations could net a minimum penalty of $37,500, totalling about $740 million. Any award from a lawsuit would go to the U.S. Treasury. Under federal law, after a notice of intent to sue is filed, defendants have 60 days to get into compliance, and state regulators have 60 days to take enforcement action. Churchill Downs Reaches Agreement With NBC Sports
KENTUCKY....
Churchill Downs Inc. and NBC Sports have reached a five-year agreement in principle to extend the network's exclusive rights to air the Run for the Roses, which has been on NBC since 2001. Under the agreement, the Kentucky Derby will remain on NBC through 2015. Last year's race was seen by an average of 16.5 million viewers, making it the most-watched Kentucky Derby since 1989, when 18.5 million people saw Sunday Silence run to victory. The last time the race was shown on ABC, in 2000, only 9.1 million tuned in for Fusaichi Pegasus' win. The new deal includes programming rights to the Kentucky Derby's sister race, the Kentucky Oaks, and other coverage from Churchill Downs on the first weekend in May. The Oaks has been aired on NBC-owned cable channel Bravo the past two years.

A small airline based near Atlanta plans to offer low-fare nonstop commercial flights between Atlanta and Louisville, Ky.
Vision Airlines, based in Suwanee, said Thursday it plans to begin operating two daily roundtrip flights between the two cities on Dec. 13 with tickets starting as low as $99.
The airline says a low-cost option is needed because of the strong business ties between the cities.
The route will initially be served by 32-seat turboprop planes, but the airline may put its larger Boeing 737 jets on the route as demand increases.
Vision says it may soon add flights to destinations in Florida from "seriously underserved cities."
Vision started in 1994 offering aerial tours of the Grand Canyon, and now operates charter flights for a variety of clients.

Children Saved...Woman Dies In Fire

Authorities say a woman died helping five young children escape from a house fire in Kentucky.
Louisville Fire Capt. Sal Melendez says the woman, whose name has not been released, died at University Hospital Thursday morning. The woman had to throw some of the children out of a window to rescuers because there was no other way to save them.
Melendez says the woman collapsed after all the children were out.
Firefighters say the children, who are all younger than 10, suffered minor smoke inhalation but are expected to be OK.
The cause of the fire is under investigation.

Violence Shelters Seek Funding For Food

Domestic violence shelters across Kentucky are being hit hard after their exclusion from the U.S. Department of Agriculture's Commidities Program came without warning. The federal grant was traditionally used to buy food for residents. Federal officials say this type of shelter was never supposed to get food aid in the first place. Instead, it was reserved for places like homeless shelters and soup kitchens. A recent federal government audit turned up the long-time mistake. Those violence shelters are now seeking funding from donors.

As part of a $42.5 million award from the Centers for Disease Control and Prevention, Kentucky will receive $1 million in federal grant funding over five years aimed at improving performance management for state and local health departments. The Kentucky Department for Public Health may use the funds to collect data to inform decisions, monitor and evaluate quality, make improvements throughout the state public health system and to hire two full-time staff members to focus on systems and processes within the state health department and coordinate comparable activities at local health departments.

Attack Survivor In 2006 Charged With Murder

A central Kentucky man who survived a violent attack in 2006 is now charged with killing an acquaintance.
41-year-old Mitchell Turner of Berea was arrested Monday and charged with murder in the death of 53-year-old Gary Deaton.
Trooper Chris Lanham said the men had been drinking together and police believe that alcohol played a role in the slaying.
Madison County Coroner Jimmy Cornelison said an autopsy showed Deaton died of blunt force trauma and possible stab wounds.
Turner survived several gun and knife wounds in an attack in 2006 in which his girlfriend was killed.

Former Delegate Pleads Guilty

Former Logan County House of Delegates member Joe C. Ferrell pled guilty Thursday to one count each of racketeering and tax fraud charges. Ferrell was first indicted along with his business, Southern Amusement Inc., on dozens of counts last year. The most serious charges allege he used the company to run an interstate gambling operation. Ferrell admitted he paid employees under the table and used his video lottery leasing company to run illegal gambling across state lines. Ferrell said his video poker machines paid out illegally in Kentucky, and he admitted to bribing a West Virginia Lottery investigator as part of that racketeering charge. Ferrell also pleaded guilty to failing to pay $38,000 in employee-related federal taxes owed in 2003. He's already paid $600,000 as part of his plea deal, and must divest from Southern Amusement. He will be sentenced January 5th.
Oregon Woman Sentenced To Life In Prison

Korena Roberts of Beaverton, Oregon has been sentenced to life in prison after pleading guilty to fatally beating 21 year old Heather Sniveley, originally from St. Albans, in June 2009. Investigators say Roberts killed Snivley, who was seven months pregnant, cut the baby from her womb and then left Snivley's body in a crawl space of her home in Beaverton. Roberts claimed she had just delivered the baby, but, when it was rushed to the hospital and could not be revived, officials discovered the baby was not Roberts'. Her attorney asked for the murder, kidnapping and robbery charges against her to be dropped, but the judge denied that request.

To reduce flooding in the Island Creek basin in Logan, the U.S. Army Corps of Engineers has awarded a $5.8 million contract which will allow for the streambed of Island Creek to be widened to 80 feet for a distance of 3,600 feet upstream from the Guyandotte River. Construction is expected to begin November 2010 and will take about four years to complete.

Nitro Man Arrested After Taking Car For Debt

John Richard Thomas III, 21, of Nitro has been arrested and charged with burglary and grand larceny after allegedly stealing a woman's car in an attempt to collect a debt she owed him. Police say Thomas went to the home of Julie Eads and told her he needed the money he'd loaned her. When Eads told him she didn't have any money, Thomas went into a downstairs area of her home before heading back outside where she saw him sitting in one of the cars in her yard that she'd posted for sale. According to the complaint, Thomas drove off in her maroon 1993 Chevrolet Sportsvan, valued at about $2,000.

Thursday, Governor Joe Manchin appointed Thomas Mike Porter, Jr. from Bluefield to take his father's place in the state House of Delegates. Mercer County Delegate Mike Porter, Sr. held the position until his death on September 27th. Porter, Sr. had been seeking reelection out of the 25th District and his name is on the ballot for the November general election.

An effort is under way to improve the West Virginia Schools for the Deaf and Blind’s curriculum and operations. The West Virginia Board of Education approved several recommendations for the Romney school on Wednesday. They include forming a partnership with the Hampshire County school system to identify programs and services that could be shared. The school also will seek accreditation from the Conference of Educational Administrators of Schools for the Deaf. The changes are based on an audit conducted earlier this year by the Office of Educational Performance Audits. Director Kenna Seal said in his report that auditors were concerned about the quality of the school’s curriculum.

New Massey Rules Approved

Wednesday, Massey Energy stockholders approved several new corporate governance rules at a meeting in Richmond. Among the proposals that received enough votes were declassifying the board of directors; removing super majority vote provisions related to stockholder amendment of bylaws; and removing the prohibition of the right for stockholders to request special meetings of stockholders. The proposal that would have changed the way shareholders vote for board candidates did not pass. Massey officials say the new rules will benefit shareholders.
Massey Mine Issued Closure Orders

Thursday, MSHA announced it has issued 11 closure orders to Massey Energy owned Elk Run Coal Co.’s Seng Creek Powellton Mine in Boone County. MSHA says, during a surprise visit on September 28th, mine inspectors discovered the mine was taking illegal cuts into the coal seam, operating without proper ventilation and not completing required air readings, which are needed to assure there is sufficient air flow to prevent mine explosions. MSHA Assistant Secretary of Labor Joseph A. Main says the violations are a blatant disregard for the federal regulations, and the results of the Seng Creek inspection only reinforce the need for new legislation to halt these kinds of practices. Massey Energy Spokesman Jeff Gillenwater says discipline was issued immediately, while the foreman and two hourly workers were discharged, and nine additional miners were suspended for three days.

Members of the West Virginia Turnpike Authority gave final approval Thursday to a plan to place a toll plaza on the Mon-Fayette Expressway. Under the plan, a single toll plaza will be placed just north of the Interstate 68 intersection of the new highway in the Cheat Lake area and also at the Pennsylvania end of the expressway. The toll plaza in Monongalia County will collect funds to pay for West Virginia's end of the road. The Mon-Fayette Expressway is scheduled to open in the spring of 2011.

Former Executive Director Charged With Embezzlement

Jonathan Steven Deutsch, the former executive director of the Constructors' Laborers Council of West Virginia and former assistant professor at the University of Charleston, appeared before a federal magistrate Thursday on embezzlement and fraud charges. Deutsch was arraigned on 25 criminal counts after being accused of embezzling $750,000 from the organization and using the money to buy, among other things, expensive cars and homes. Deutsch is scheduled to go on trial December 7th.

Eligah Shyquan Payton, 19 of Charleston has been charged with carrying a concealed and dangerous weapon. Charleston Police say, Wednesday afternoon, they received a call about a suspicious acting man in the liquor aisle of the Rite-Aid on Charleston's West Side. When Police arrived, Payton came out of the restroom and attempted to leave the store. Police patted him down and found a .25-caliber pistol on him.

Murder Charge Goes To Grand Jury

KENTUCKY....
Wednesday, a hearing was held to determine whether 32 year old Robert Powers of Hager Hill should stand trial for murder following the death of 11 year old Austyn Stapleton. A Johnson County Sheriff's deputy testified that witnesses say the truck Powers was driving last Friday afternoon was swerving and speeding down route 321 near Paintsville, finally hitting a car driven by Austyn Stapleton's mother. Deputies say they did not smell or find any alcohol or drugs on Powers, but he failed every sobriety test. Deputies agree shock could have caused Powers' confusion. The judge found probable cause to send Powers first offense DUI and murder case to a grand jury. Blood test results are pending. Powers remains jailed on a one half million dollar bond.
Former President Bill Clinton To Campaign For Conway

KENTUCKY....
Former President Bill Clinton is scheduled to come to Kentucky on Monday to campaign for Democratic U.S. Senate nominee Jack Conway. Clinton’s close friend, Lexington businessman Jerry Lundergan, confirmed Wednesday the scheduled visit but said the location of Clinton’s visit has not yet been finalized. Polls have shown Conway generally trailing Republican Rand Paul, although some recent surveys have shown the race in a statistical dead heat. A recent Wall Street Journal/NBC poll showed Clinton as the most popular politician in the country, but Paul’s campaign manager, Jesse Benton, said in an e-mail, “Jack Conway is welcome to bring in all of the out-state liberals he wants. We hope he has (U.S. Rep.) Charlie Rangel campaign for him again like he did in 2002." Several popular national Republicans have appeared in Kentucky on behalf of Paul’s campaign, including former Alaska Governor Sarah Palin and former Arkansas Governor Mike Huckabee. Paul and Conway are scheduled to participate in a debate Monday night in Covington for the Northern Kentucky Chamber of Commerce.
E-Mail Ballots For Overseas Voters

Under new federal voting requirements, military voters in Tennessee and Kentucky who are overseas during the November 2nd election can now get their ballots by e-mail and track their ballot online. The Military and Overseas Empowerment Act that passed last year requires all states to provide timely and electronic access to voter forms to help reduce the time it takes to get absentee ballots from military and overseas voters. According to the Overseas Vote Foundation, more than half of surveyed voters in 2008 who tried but could not vote were unable to because their ballots were late or did not arrive. Voters still have to return marked ballots by mail. While the e-mail option is quicker, soldiers will still need to find a way to print the attached documents.
KLC Names New Executive Director

KENTUCKY....
In a unanimous decision of the Kentucky League of Cities executive board, Jonathan "Jon" Steiner of New Hampshire has been named the new executive director of the KLC. Steiner, who succeeds acting executive director Neil Hackworth, comes from the New Hampshire Local Government Center/New Hampshire Municipal Association, where he is deputy director for member services. Steiner received an undergraduate degree and a master's degree in public administration from the University of New Hampshire and a master's degree from Dartmouth College. Steiner's first day at KLC will be November 1st.
KFC Converts Restaurants To Feed Those In-Need

KFC announced Wednesday that to raise awareness for World Hunger Relief efforts, it shut the doors of its two most historic locations, Colonel Sanders' first restaurant in Corbin, Ky. and the original KFC franchise in Salt Lake City. KFC converted the restaurants into "World Hunger Relief Kitchens," serving free meals to in-need residents from local shelters. The Corbin restaurant, which has operated since 1940, was closed on Monday. The Salt Lake City location, which has been serving customers since 1952, closed Wednesday.
Former Miss Kentucky Latina Charged With Assault
KENTUCKY....
A beauty queen has lost her crown. Former Miss Kentucky Latina, 22 year old Daniela Gaskie is facing felony charges of disorderly conduct and criminal mischief after she allegedly assaulted two people in Madison County. Police say she was arrested last Wednesday after she stabbed employee Jonathan Carpenter in the neck with a pen after he didn't let her into the Swifty gas station in Richmond. Police say Gaskie apparently then ran across the street and got into a fight with pharmacist Mary Ann McKinley in the parking lot of M&M drugs. The 59-year old pharmacist says Gaskie punched her in the stomach, kicked her and tried to bite her. Police say they believe alcohol was a factor in the alleged attacks. Acirema Alayeto, the president of Miss Latina U.S., said Tuesday that Gaskie "no longer represents the organization."

Bridge Work In Wolfe And Magoffin Counties

Motorists using the Bert T. Combs Mountain Parkway in Wolfe County can expect lane closures and possible delays during the next month, as work begins on a bridge repair project at Exit 40 near Pine Ridge.
Repairs will be made to the bridges carrying the Mountain Parkway over KY 15. Work will be done simultaneously in both the eastbound and westbound lanes. Construction began yesterday and should be finished by Nov. 15. While the project is ongoing, one lane will be closed in each direction.
During the work, the route will be restricted to vehicles less than 12 feet wide. Vehicles wider than 12 feet will need to find an alternate route around the project.

Murder Charges For Anderson Co. Man

KENTUCKY...
An Anderson County man has pleaded not guilty to murder charges.
Gary Bancroft is charged with the murder of his girlfriend, 33-year-old Frances Renee Mobley, in September 2010.
Mobley's body was found at Bancroft's home, just outside Lawrenceburg.
Bancroft is being held at the Franklin County Regional Detention Center.

The Kentucky Division for Air Quality is asking for proposals from local governments for projects that would aim to reduce diesel emissions in municipal fleets.
A statement from the Division for Air Quality says diesel engines are one of the largest sources of harmful particulate matter in the country. A total of $235,000 is available for the proposals.
The division says emission reductions may be achieved various ways, including vehicle replacement, retrofit devices and technologies that reduce idling.
The competitive funding is open to any county, city or other local government agency in Kentucky that owns and operates its own eligible diesel vehicles or equipment.

Memorial Held In Rememberance Of UBB Miners

To mark the six-month anniversary of the April 5th Upper Big Branch Mine explosion in Raleigh County, friends and family members held a memorial service in Whitesville Tuesday in remembrance of the 29 miners who died in the explosion. Family members lit 29 candles to represent the lives lost. Those candles will stay lit for eight days, the same amount of time it took for the candles to go out when they were lit immediately following the explosion. Congressman Nick Rahall, who was at the service, says family members still have a lot of questions and doubts about the cause of the explosion, but it's a process that will take patience to find the answers that will bring closure.
West Virginia Sues EPA

WEST VIRGINIA....
The state and federal government have long been at odds regarding the issuance of surface coal mining permits, particularly for the Spruce Fork No. 1 mine in Logan County. During a news conference at the Capitol Wednesday, Governor Joe Manchin announced he is suing the Obama administration in an attempt to overturn its efforts to curb mountaintop removal coal mining. Manchin said negotiations that began a year and half ago have brought no satisfaction even though legal actions began in April. The federal Environmental Protection Agency and the U.S Army Corp of Engineers are named as the defendants in the lawsuit. Manchin has been in contact with both the governors of Virginia and Kentucky and believes they may join West Virginia in the lawsuit. The agencies have 60 days to respond to the lawsuit.
Lawsuit Filed Against Bayer And West Virginia State University

Portia Gray, the mother of former West Virginia State University student 19-year-old Ra'Sean Gray who died on on September 18, 2008, is suing Bayer CropScience and the school over her son's death. Gray died as a result of exposure to substances released during an explosion at Bayer's Institute plant. An autopsy determined the cause of death was a blood clot in the main artery of the lungs. Bayer spokesman Tom Dover says, based on the company's assessment of the 2008 incident, Bayer continues to believe there was no health risk to the general public. According to the lawsuit, Gray remained indoors at an unspecified location after a shelter-in-place order was issued on the night of the explosion, and, later that night, he returned to his dorm room where the window was open and the room was covered with a dust or soot. There also was a foul-smelling odor.

American Electric Power has more than 439,000 customers in 24 West Virginia counties. The West Virginia Public Service Commission has signed off on a new program from AEP which is set to begin by March 2001. The Energy Efficiency and Demand Response Program is designed to encourage more efficient use of electricity, while providing assistance with managing electricity usage, reducing electric bills and conserving energy resources. A less than 50 cent a month rate increase will allow AEP to be reimbursed for part of the program's total cost.

Man Arrested Over Concealed Weapon

Charleston police have been cracking down on illegal weapons in the city. Officers on a routine foot patrol approached a car at Hunt Avenue and Orchard Street because of loud music coming from the vehicle. When police gave a warning to the driver, Earl Nathaniel Croner, 24, of Beckley, that he was in violation of the city's noise ordinance, they noticed an empty pistol holster on Croner's belt and asked him about it. That's when police say he told them he had a handgun under his seat. Police recovered a .40 caliber Hi-Point pistol and charged Croner with illegally carrying a concealed weapon.
Rasmussen Poll Shows Raese Continuing To Lead Over Manchin

The latest Rasmussen poll, released Wednesday, shows Morgantown businessman John Raese with a 50 percent to 44 percent lead over Governor Joe Manchin, with just five percent undecided, in the race for U.S. Senate. The Rasmussen Reports poll, which showed last week, for the first time, a Raese lead of 48-46, has now moved the race from "Toss-Up" to "Leans GOP." Tuesday, Rasmussen pollsters conducted phone conservations with 750 likely voters. The poll has a margin of error of plus or minus four percent.
Putnam County School Board Considering Random Drug Testing

To combat drug use on school sports teams and in other after-school programs, Putnam County School Board members are considering a new policy which would require students to sign consent forms that allow them to be randomly drug tested in order to participate in extra-curricular activities. The policy also requires student drivers and parents to sign the consent form. Students refusing to sign the forms will be barred from participating in extra-curricular activities or from driving to school.

The voice recorder, which Crouse said she planted every day for several weeks, allegedly recorded Francisco and Rogers calling the students babies and telling them they do not belong in kindergarten.

Eric White, 36, of Huntington was arrested by U.S. Marshals at a gas station in Stroudsburg, Pa., at about 7:00 P.M. Tuesday. White walked away from the Huntington work release center on September 13th, where he had been working after being paroled on a conviction for transferring stolen property. Officials almost caught White in front of Playmates bar near St. Albans on September 17th, but he charged marshals with his car, hitting two federal vehicles, causing one of the marshals to open fire at his vehicle. He then pulled onto U.S. 60, where he hit another car before abandoning his vehicle and fleeing on foot. White and his girlfriend, Samantha Priddy, kept running until they were tracked down in Pennsylvania. White faces numerous charges stemming from the escape and flight.

Massey Waiting For MSHA Decision

On September 28th, the Office of Miners' Health, Safety and Training approved a plan to allow Massey Energy to hold its own, separate investigation into what caused the April 5th explosion that killed 29 miners at the Upper Big Branch Mine. Massey has been waiting for a decision from MSHA officials who still have not permitted Massey investigators to initiate their probe. Massey says it has a team of some of the "nation's best accident investigators" to investigate the UBB mine explosion, and that "under the Mine Act, companies are required to conduct their own investigation.

Kentucky State Police are investigating following an attempted armed robbery in Pike County which occurred around 8:00 A.M. Tuesday morning. Police say, just before the Quality Tobacco in the Buskirk Mini Mall opened, a man with a hand gun demanded an employee open the locked door, but, when the employee refused, the man fled the scene.

Baptist Seminary Finds Home At Georgetown College

The Baptist Seminary of Kentucky has found a new home at Georgetown College after its second relocation in less than a decade.
But seminary leaders say settling on the college campus with a Baptist affiliation could be the last stop.
President Greg Earwood said moving to the college campus is an important step in gaining accreditation.
The seminary, which moved to the college's Ensor Learning Resource Center in August, will remain separate from the college and has its own board of trustees.
The seminary prepares ministers to serve churches nationwide. It started holding classes at Calvary Baptist Church in Lexington in 2002, and after three years, moved to the Lexington Theological Seminary.

The draft Integrated Resources Plan is intended to help TVA's efforts to meet regional electricity needs over the next 20 years.
The public can comment through November and then TVA will submit the plan to the Environmental Protection Agency for a review of the environmental impact.
TVA supplies power to nearly 9 million people in Tennessee, Alabama, Mississippi, Kentucky, Georgia, North Carolina and Virginia.

A western Kentucky police officer has been fired after an altercation with a detainee who was being booked at the jail.
The Owensboro City Commission voted 5-0 on Monday to terminate Fred Coomes' employment with the city for excessive force, conduct unbecoming an officer and impeding an internal investigation.
The commission listened to 11 hours of testimony about the April 7 incident before making the decision.
Coomes said during his testimony that he wasn't trying to provoke a fight, but could have handled the situation better.
A complaint from a jailer said Coomes had a verbal altercation with the detainee, then it appeared he struck the person.
Police Chief Glenn Skeens said he didn't believe Coomes' explanation and thought he should be fired.

Pontoon Doctor Sentenced To Five Years

A central Kentucky doctor convicted of killing his wife by running her down with a pontoon boat has been sentenced to five years in prison.
Boyle Circuit Judge Darren Peckler followed the jury's recommendation in sentencing Steven Hall on Tuesday.
A jury convicted Hall of second-degree manslaughter in the death of his wife, Isabel Lynn Hall, who was run over on Herrington Lake in May 2009 by a pontoon boat her husband was driving. Steven Hall has maintained the death was accidental.
The judge refused a defense request to probate the sentence, citing the "seriousness of the offense."
Hall's attorney says his client has been incarcerated since last May and will be eligible for a parole hearing within six weeks.
No Fraud In Insurance Procurement In Lexington

The review does recommend some procedural problems be fixed, the Lexington Herald-Leader reports. Auditors recommend revamping the Internal Audit Board and changing several purchasing policies.
The audit analyzed the procurement process for the city's insurance services after a city employee alleged there was possible fraud involved.
Auditor Crit Luallen said the recommended measures could have stopped the issue from becoming a public controversy.

Gun Laws Under Review In Boone County

KENTUCKY...
The Boone County Fiscal Court is considering allowing citizens to carry concealed deadly weapons on county property, including parks and buildings.
The fiscal court is scheduled to consider the new ordinance. The Kentucky Enquirer reports it would allow citizens who are properly licensed to carry guns on county property.
Some offices would still ban guns under the new ordinance, including prosecutors' offices, the Boone County Sheriff and jailer.
Current law bans carrying concealed weapons into all buildings the county owns, leases or controls.
Animal Rights Group At WEG

An animal-rights group is unveiling an exhibit at the World Equestrian Games in Lexington that will showcase the history of efforts in the U.S. to protect horses.
The American Society for the Prevention of Cruelty to Animals says its exhibit will be featured at the Kentucky Horse Park's International Museum of the Horse. The exhibit is being unveiled Tuesday.
Equestrian rider Georgina Bloomberg will join equine experts from the animal-rights group at the ribbon cutting ceremony during the equestrian games.
Kentucky Horse Park executive director John Nicholson says the exhibit offers an important reminder of the efforts and strides made to improve the lives of horses.

The money will cover the salary and benefits for a new officer, while about $193,000 will go toward the installation of solar panels at the city’s wastewater treatment plant. Mayor Scott Edwards says the city spends about $15,000 per month on electricity for the plant, but solar panels will bring that down by about $1,000 per month, meaning that, over a nine year period, the city will save about $100,000. In the last 45 days, Hurricane city leaders have found they're getting a total of about $500,000 for different projects. Part of that funding is a federal government matching grant of nearly $50,000 which will go toward a "splash-ground" within Hurricane City Park which will cost about $170,000.
The city is in the fund raising process.

Gagnon is accused of approaching six black women who were having a bake sale and telling them he hated black people. Police say he swung his fist toward one woman and exposed himself. He was taken to the Eastern Regional Jail and placed on a $10,600 bond.

Fire officials in Kanawha County say, when firefighters arrived at a home on Keith Drive in Cross Lanes around 5:00 P.M. Monday afternoon, they discovered heavy flames in the front of the house, the front picture window blown out of the home and the body of David Ward close to the front door where he was found dead.

Inmate Faces Additional Charges

Kanawha County officials at the South Central Regional Jail say Roy Anthony Harvey, 32, of Cabin Creek, was playing cards with inmate Telly Larry at the jail on September 13th when Harvey allegedly began taunting and punching him. Larry eventually decided he had to fight back, and was getting the better of Harvey when Harvey allegedly bit off the tip of Larry's nose. Larry was treated at Thomas Memorial Hospital and requires plastic surgery to repair the damage. Harvey is charged with malicious wounding.

Funding To Help South Charleston Technology Park

Higher education officials plan to use $12 million in stimulus funds to renovate and operate a research and technology park in South Charleston.
The Higher Education Policy Commission will take control of the campus of the West Virginia Education, Research and Technology Park from Dow Chemical in mid-December.
The commission planned to vote Tuesday to accept the stimulus funding from the governor's office.
Vice chancellor Paul Hill says the funding will allow the commission to modernize the park's buildings and get them ready for occupancy.
About $4 million will be used to pay for electricity, sewer, water and other operating costs.

Man Charged With Child Abuse Causing Death

Larry Allen Hayes Jr., 21, lived with his girlfriend, Meredith Bush, and her 18 month old daughter, Rebecca McDaniel in South Charleston. Bush told police that last Thursday, Hayes dropped her off at her job at IHOP at Trace Fork, and, while on his way to pick her up that afternoon, he called and told her something was wrong with her daughter. When Hayes arrived with the girl, Bush saw she wasn't breathing and started CPR. Friday, police were called to CAMC Women and Children's Hospital where the child was on a ventilator and had no brain activity. She died Sunday. An autopsy showed the girl died from "multiple blunt force impacts to her head which caused multiple subdural hematomas. Friday, Hayes told police he was the only person with Rebecca during the day on Thursday, and nothing happened that could have caused her injuries. When interviewed Monday, Hayes said he had fallen down the stairs while carrying the girl and landed on top of her, but he had not spoken up before because he was scared. Letcher County Man Convicted

A Letcher County jury returned a guilty verdict Monday in the case against Jeffrey Allen, convicting him of the murder of his two year-old foster child, Dakota Yonts who died in 2003. Allen was convicted in 2006, but a retrial was ordered in 2009. The jury recommended he spend life in prison.

Governor Steve Beshear said Monday Kentucky's Medicaid recipients are now eligible for products and medications to help them stop smoking. To participate in the program, recipients must be evaluated by a doctor, an advanced practice registered nurse or a physician assistant, and enroll in counseling programs. The state legislature allocated $1.5 million a year in state funds for this year and next to implement the program. Federal matching funds are projected to be $4.7 million this year and $3.7 million next year.

State Attorney General Jack Conway announced Monday that Kentucky's Medicaid program will get $132,108 as part of a settlement with Botox manufacturer Allergan USA over allegations of deceptive and illegal marketing of Botox. Allergan has agreed to pay $225 million to resolve civil and criminal claims that it persuaded doctors to submit false claims to the Medicaid program and paid illegal kickbacks to doctors to get them to prescribe Botox for off-label uses. It was alleged that Allergan told doctors how to falsify Medicaid claims by using inapplicable diagnosis and billing codes to ensure payment, and that it illegally promoted Botox as a safe and effective treatment for headaches, pain, spasticity and overactive bladder, even though the Food and Drug Administration hadn't approved it for those uses.
Kentucky's share of the settlement is $472,249 — double the amount the state Medicaid program spent on prescriptions written as a result of the company's off-label marketing.

Police in Pike County say a man and woman are dead after an apparent murder/suicide at a grocery store Monday morning.
The incident happened at about 6:45 a.m. at Johns Creek Grocery on Bent Branch Road at Meta. Police say they responded to a call of a possible armed robbery in progress. When they arrived, State Police say they discovered Jeanetta Leedy, 38, and Jimmy R. Leedy, 44, deceased inside the business. Police say evidence at the scene indicated that Jimmy Leedy came into the business, where his wife worked. armed with a pistol. Jimmy Leedy fired a shot, striking Jeanetta Leedy, and then turned the weapon on himself, taking his own life.

Paul says too many people are receiving the insurance who don't really need it, noting half the state's births are covered by it.
Kentucky has about 57,000 births per year, and Medicaid covers about half of them, according to Gwenda Bond, a spokeswoman for the state Cabinet for Health and Family Services.
Paul's campaign has said that about half of Paul's medical income has come from Medicare and Medicaid payments.

Assistant UK Dean Arrested

Ray Dowd, 49, assistant dean at the University of Kentucky, was arrested Saturday afternoon and is facing charges after a woman reported he was acting suspicious outside her apartment at the Springhouse Apartments. He is facing charges of criminal trespassing and giving a false name and address to a police officer, but also faces other accusations after the woman also told police that he was the same person who exposed himself to her weeks earlier. UK officials said Monday that Dowd is still employed with the university. They also said they know about Dowd's arrest, and did not say if they will take any disciplinary action towards him.
Dowd was released on bond on Sunday.

Secretary of State Trey Grayson is encouraging citizens to take an active role in the upcoming general election by signing up to become a precinct election officer. Precinct election officers, or poll workers as they are sometimes called, are still needed in many counties across the state, and now is the time to sign up and participate.
To serve as a precinct election officer, you must be a qualified voter, have not changed your party affiliation one year prior to the appointment, not be a candidate for office during the election year, and shall not be the spouse, parent, brother, sister, or child of a candidate who is to be voted for at the election in the precinct in which the election officer will serve on election day. Voters who will be 18 on or before November 2, 2010 are eligible to serve in the upcoming general election.
Each precinct in the state is required to have four precinct officers serving on the day of the election. Each election officer is paid a minimum of sixty dollars per election, as well as additional payment for mileage and mandatory training.

Elderly Woman Dies In Fire

Yesterday, an early morning house fire killed a woman in central Kentucky.
The blaze broke out at a home in Harrodsburg before dawn Monday. Family members say a 71-year-old woman died in the fire. Authorities didn't immediately release the victim's name.
The flames heavily damaged the home and fire officials could not immediately tell what caused the fire.

Kentucky State Police say an eastern Kentucky man has been found dead after a fight at a mountaintop party.
A release from the Hazard post of the KSP stated the family of Julius Edward Williams of Vicco reported him missing early Sunday when he didn't come home after the party.
A search was begun and the 45-year-old Williams was found dead in some weeds near where the fight had taken place.
The State Medical Examiner's Office in Frankfort will conduct an autopsy to determine how Williams died.

Hampshire County Deputy Sheriff Found Dead

An investigation is underway after a Hampshire County Deputy Sheriff was found dead in South Cumberland, Maryland. Police were dispatched to Industrial Blvd and Virginia Avenue at 3:00 A.M. Sunday after CSX employees found the body of Bradley Timbrook, 24, of Romney. Police say Timbrook was last seen with his friends a few hours earlier near Oldtown Road. The investigation shows Timbrook was struck by a train sometime between 1:30 and 3:00 A.M. when officers arrived.

Raleigh County Sheriff's Deputies have arrested Bernard Joseph Garrison and his wife Jennifer and charged them with first-degree murder in connection with the death of Toby Harrah. Harrah died several days after receiving electrical burns as he allegedly tried to steal copper from an American Electric Power substation in Pemberton in September. Bernard Garrison confessed to the Aug. 13 robbery of Godfathers Tobacco and Liquor in Bradley, which led detectives to charge him with first-degree robbery and conspiracy to commit a felony in connection to that hold-up.

Chapman further admitted he was provided notice that possessing a firearm or ammunition while the protective order was in effect may be a criminal offense under federal law.

A magistrate heard testimony during a preliminary hearing Monday in Ripley and decided to forward the case. Davis had been released from prison August 24th after serving nine years in the murder of his brother.

Detectives found Bryan Sirbaugh, 37, of Kanawha City, in a room at the Holiday Inn Charleston House, along with six individually wrapped packages of suspected heroin inside an empty pizza box. During the investigation, Michael Douglas Bays, 26, of Cross Lanes, knocked on the hotel room door, and detectives were granted permission to search his book bag, where they found a loaded .25-caliber handgun. Sirbaugh faces felony possession with intent to deliver heroin charges and is on a $105,000 cash-only bond. Bays faces misdemeanor carrying a concealed weapon charges and is on a $250,000 surety bond.

Senator Urges Closer Look At Tax Cuts

Mike Oliverio, a state Senator from Monongalia County, says now is the time for the U.S. House and U.S. Senate to look again at the tax cuts that were first enacted more than nine years ago under the the George W. Bush administration. Last week, Congress went into recess until after the midterm elections without taking a vote on an extension of the tax cuts that have been in place since 2001 and 2003 which lowered marginal rates, dividends and capital gains taxes, and, without action, will expire at the end of the year. Oliverio says tax credits and tax savings for working class Americans need to stay in place.
Mike Oliverio, a state Senator from Monongalia County, says now is the time for the U.S. House and U.S. Senate to look again at the tax cuts that were first enacted more than nine years ago under the the George W. Bush administration. Last week, Congress went into recess until after the midterm elections without taking a vote on an extension of the tax cuts that have been in place since 2001 and 2003 which lowered marginal rates, dividends and capital gains taxes, and, without action, will expire at the end of the year. Oliverio says tax credits and tax savings for working class Americans need to stay in place.
West Virginia Prison On Lockdown

A federal prison in Glenville remains on lockdown after a fight involving about 75 inmates late last month.
Federal Bureau of Prisons spokeswoman Traci Billingsley says the melee broke out in the recreation yard at the Federal Correctional Institute-Gilmer on Sept. 23. No staff members were hurt, but several inmates were treated for injuries at the prison and three required treatment at a hospital.
Billingsley says there was no danger to the local community, She could not say whether the fight was gang-related.

Conway And Paul Debate On National TV

Appearing on Fox News Sunday with host Chris Wallace, Kentucky’s U.S. Senate candidates, Democrat Jack Conway and Republican Rand Paul debated about how best to fix the economy, shore up federal entitlement programs and fight drug abuse, among other things. Paul accused Conway of being a surrogate for President Barack Obama’s agenda, citing Conway’s support for a federal health care overhaul law and the federal stimulus bill, while Conway tried to distance himself from the president, who is unpopular in many parts of the state, by staking out positions contrary to Obama on three key issues. Conway said he would vote to extend tax cuts enacted under former President George W. Bush, would have opposed a federal bank bailout because it lacked accountability and would have voted against a “cap-and-trade” bill to control carbon emissions because it would have increased electricity rates and hurt the coal mining industry. Paul accused Conway of flip-flopping on those issues, saying, during the primary election, he made more nuanced statements about the bank bailout, extending tax cuts and cap-and-trade. Conway continued to highlight past statements by Paul that Conway says shows Paul is out-of-touch with the mainstream values of Kentucky, such as saying drugs aren’t a pressing issue, non-violent behavior shouldn’t be a crime, he is against the American Disabilities Act and Medicare needs a $2,000 deductible.

Kentucky State Police, the National Guard and the Jackson County Sheriff's Department conducted a drug round-up Friday. In all, 16 suspected drug dealers were arrested, and deputies seized marijuana, pills and a sawed off shotgun.

Fatal Accident In Pike County

Kentucky State Police officials are investigating following a fatal accident in Pike County. Police say 26 year old Lacy Pauley, Jr. of Pikeville was driving his motorcycle on Collins Highway when he collided with a van. Pauline Loudermilk, 76, of Kimper, a passenger in the van, and Pauley died in the crash.
Horse And Rider Take Spill At World Equestrian Games
KENTUCKY....
Juan Carlos Garcia and his horse, Iman Du Golfe, were injured Saturday during the cross country event at the World Equestrian Games when the horse fell at fence 20. The fall caused a deep cut on the horse's left elbow and Garcia was tossed. He was checked out at the hospital and released just hours later. The horse was treated by a vet who says it didn't break any bones.
Knott County Trail Ride A Big Winner
KENTUCKY...
Thousand of people from all over Kentucky and the surrounding states made their way to Knott County with their horses to enjoy the Knott County trail ride.This is the fourth year the weekend-long event has taken place and officials say it gets bigger every year.
There were camps set up for miles at the Knott County trail ride. Everywhere you went people were riding horses, walking around and just having a good time.
"It's just good, clean, wholesome family fun. It's about people getting together and socializing that have common interests. They enjoy the outdoors, the beautiful weather," said Randy Thompson, the Knott County Judge Executive.
The scenery also seems to draw people in.
But most people come for the horse trails.
The trail ride may focus on horseback riding, but there's plenty to do for people who don't have horses. There are vendors and booths set up, food and even live music at night.
Officials say this year's event is the biggest one to date. The trail ride officially started on Friday, but officials say people started showing up days in advance.
Hal Rogers Looking For 16th Term

The race to represent Kentucky's 5th Congressional District is a repeat match between a politically powerful Republican incumbent with a substantial war chest and a Democratic political neophyte with meager coffers and virtually no financial support from his party.
Republican U.S. Rep. Hal Rogers of Somerset, known for steering federal money toward projects in his district, may well be on his way to a 16th term.
Rogers, 72, had raised more than $500,000 as of the June campaign finance filing deadline — much of that donated by the defense industry, an effort aided by connections he made while once serving as the first chairman of the House subcommittee on Homeland Security.
Meanwhile, Democratic challenger James "Jim" Holbert, 58, an emergency medical services helicopter pilot from London who is serving as his own campaign treasurer, has struggled to scrape together $10,000 for his grass-roots bid.
Wal-Mart Parking Lot Fatality
KENTUCKY...
A Cynthiana woman died Friday after being hit by a vehicle at the Wal-Mart parking lot in Cynthiana, according to a release from the Fayette County Coroner's Office.
Sylvia Fight, 74, was pronounced dead at 6:12 p.m. at University of Kentucky Chandler Hospital.
Police say Fight was leaving Wal Mart around 10 a.m. when 25-year-old Lauren Watts hit her with a Chevy Blazer.
8 hours later, the great-grandmother died at UK Hospital from severe head trauma.
Earthquake North Of Richmond, Virginia

The U.S. Geological Survey says a minor earthquake has hit Virginia.
Dale Grant, a geophysicist with the USGS, said the magnitude 3.0 earthquake happened at 4:17 p.m. Saturday. Its epicenter was about 20 miles north of Richmond.
Grant said there were no reports of injuries or damages.
The quake was felt in Virginia cities including Richmond and Charlottesville and as far as 339 miles away in Canton, N.C.
Grant said the small earthquake is "not totally unusual" for the state, and there have been small quakes in the area before.

Letcher County Murder Retrial Going To Jury

KENTUCKY...
Jeffery Allen was accused of murdering his two year-old foster child, Dakota Yonts, in 2003 in Letcher County. He was convicted in 2006, but a retrial was ordered in 2009.
Dr. Betty Spivak and Detective Dean Craft were called to the stand Friday morning.
Craft said the defendant, Jeffery Allen, stated in 2003 that another foster child caused Dakota's bruises. Spivak said the injuries did not match the toys Allen said Dakota was hit with.
Spivak was followed by three witnesses from the defense, including Eugena Allen. According to court documents, on March 27, 2003, she returned from K-Mart, and found her husband and Dakota, reportedly lifeless, on the living room couch.
Her father Eugene Fields says he helped Jeffery Allen take Dakota to the Sandlick Fire Department. He testifies he did not notice many of the bruises medical personnel said Dakota had.
Eugena Allen says she noticed bruises on Dakota's stomach, and says she has no explanation for the hand prints on Dakota's neck. She says she believes her husband's explanation for the night Dakota died.
The trial is in recess until Monday. The prosecution and defense will make closing arguments, then the trial will go to the jury.
Unemployed And Underemployed To Get Funding

Gov. Steve Beshear, along with Kentucky Housing Corporation (KHC) Chief Executive Officer Richard L. McQuady, has announced that Kentucky will receive additional funding from the U.S. Treasury Department to help unemployed and underemployed homeowners pay their mortgages as they seek work. Kentucky originally expected to receive $55.6 million, but received notification today that that state will receive an additional $93.3 million for a total of $148.9 million.
Geared to serve low-to-moderate-income households, this loan program is funded through Troubled Asset Relief Program (TARP) funds are dedicated to the expansion of the Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (the Hardest-Hit Fund.)
Details are still being determined, but it is anticipated that the program will be launched statewide in April 2011. Until these funds are made available, Kentuckians who are facing foreclosure or near facing foreclosure can seek free help through the Kentucky Homeownership Protection Center.

Father Hits Toddler With Vehicle

A 22-month-old girl has died after being hit by her father's vehicle.
Authorities say Kinlee Lathery's unidentified father hit the girl with a Lincoln Navigator in the family's driveway Friday night in south Louisville, Ky. They say he was unable to see the child because of the vehicle's height.
He loaded the girl into his SUV and called 911 on the way to Kosair Children's Hospital. The dispatcher convinced him to pull over and wait for an ambulance, but emergency medical responders were unable to help the child.
Louisville police spokesman Dwight Mitchell says police believe the child's death was a tragic accident and no charges are expected.

$1-Millon In Drugs Seized

Police in Bowling Green say that they have stopped 70 pounds of cocaine from entering the drug market after catching a plane full of the illegal substances.
According to police, the Department of Homeland Security tipped off to the Bowling Green Police Department that a plane would be stopping in the south central Kentucky city to refuel on the evening of Oct. 1.
Police stopped the plane and seized 32 kilos (70.4 pounds) of cocaine along with the Piper Seneca twine engine plane from two Mexican men.
The total street value of the drugs is around $1,000,000.
Those two men, a pilot and passenger identified as Dagoberto Garcia-Guillen and Jesus Adolfo Garcia-Guillen, are facing drug charges including trafficking in a controlled substance to the first degree, possession of marijuana and possession of drug paraphernalia.
The pair have been sent to the Warren County Regional Jail and are being held without bond.

Man Convicted Of Voluntary Manslaughter

Lee Henley Jr. was found guilty of voluntary manslaughter in a Mercer County courtroom Friday. The 33 year old was convicted of shooting and killing Johnny Midkiff in Lashmeet in February. Police say Henley admitted to shooting Midkiff in the face near a grocery store on Route 10.
Virginia Fugitive Captured In West Virginia
WEST VIRGINIA....
A Virginia fugitive has been captured in West Virginia. Raleigh County authorities say they've arrested a man charged with first-degree murder in Virginia. Twenty-four year old Ricco Devin of Roanoke was arrested late Friday night after officers found him at the Patriot Inn Motel in Beaver. Authorities say Devin fatally shot a Virginia man on Friday following an argument over Devin's girlfriend who was found at the motel with Devin. Police also found a possible murder weapon in the room and are sending it to Virginia. As of Sunday, Devin was being held without bail at the Southern Regional Jail in Beaver awaiting an extradition hearing.
Overtime Hours In UBB Investigation Top 5,000

According to figures released last week, West Virginia's state mine office has run up nearly $200,000 in overtime pay tied to the deadly April 5th Upper Big Branch mine explosion. Overtime hours have topped 5,000 at the Office of Miners' Health Safety and Training, bringing overtime pay to more than $197,202. The agency's payroll averages $500,000 a month. All the extra cost is tied directly or indirectly to Upper Big Branch. Four safety inspections are required at each West Virginia mine every year. The state currently has about 85 inspectors to cover about 90 active surface and 170 underground mines. Likewise, state law requires investigations of all mining fatalities. State mine safety chief Ron Wooten says, "These are legislative mandates, you can't mess around with them.'' The agency's overtime costs are being paid from Governor Joe Manchin's contingency funds.

As part of an undercover operation by the Huntington Police Department to curb sexual activity at Harris Riverfront Park and Rotary Park, eleven men have been arrested during the past six weeks. Plain-clothes officers patrolling the parks have found that men use the hiking trails at Rotary Park to perform sexual acts during the day. At night, after the upper level of Rotary Park closes to vehicular traffic, the activity continues at Harris Riverfront Park. Undercover officers also have found that the men will use "lookouts" at Rotary Park to warn one another of nearby hikers and people playing disc golf. Police Chief Skip Holbrook says this activity has become a public safety and public health issue which must be addressed. Most of the men arrested have been charged with either indecent exposure or pornographic live conduct. Jim McClelland, director of the Greater Huntington Parks and Recreation District, says sexual activity has been an ongoing problem at Rotary Park for years, and, over a period of time, people really haven't been challenged, so they feel more secure at the park and their actions have become more brazen.

To differentiate between her and dozens of other radio-collared bears, they gave her a name. Quagmire lived a typical black bear life, while she bore litters of cubs, her last litter at age 25. Officials estimate she contributed about 20 cubs to the state’s bear population. Year after year biologists tracked her comings and goings by following the steady beep-beep of her collar’s radio signal. After a decade or so, followers noticed she had lived far longer than the average bear, as they celebrated her 20th year, and then her 25th. Quagmire dropped off the DNR’s map last fall, but her collar showed she was alive just before the deer firearm season. She slipped the collar not long after. Division of Natural Resources officials suspect Quagmire went into hibernation in late November or early December and never woke up.

Sissonville Fire Department Destroyed...Ruled An Accident

WEST VIRGINIA....
Fire departments throughout Kanawha County responded to a fire Friday morning that destroyed the main station of Sissonville's three stations, causing the department to lose three fire trucks, an ATV and other equipment, including the jaws of life. A temporary fire station was set up at Charleston Auto. Investigators have ruled the blaze started with an electrical fault, and it was an accident. Assistant Chief Tom Miller says the department's insurance policy covers up to $500,000, but there's been at least $1.25 million in damage.
Kanawha County Library Challenge Exceeded

Kanawha County Library leaders are attempting to raise $47 million, $40 million to buy land and build a new main library at the corner of Lee Street and Leon Sullivan Way and $7 million to improve branches throughout the county. Fundraisers raked in over $500,000 through a recent challenge grant in which John L. and Jane Ray said, if leaders raised $300,000 by September 30th, they'd throw in another $100,000. That goal was exceeded, and, by the end of Thursday, when the challenge ended, the tally had risen to $419,160.
Grant To Help With Teen Pregnancy Prevention

The U.S. Department of Health and Human Services has announced that $155 million in teen pregnancy prevention grants are being awarded to states, non-profit organizations, school districts, universities, and others, including more than $2 million in West Virginia. These grants will support the replication of teen pregnancy prevention programs that have been shown to be effective through rigorous research as well as the testing of new, innovative approaches to combating teen pregnancy. The funds come from two different programs. $100 million comes from the Teen Pregnancy Prevention program, funded by the Consolidated Appropriations Act, 2010, and administered by the Office of Adolescent Health within the Office of the Assistant Secretary for Health. The other $55 million comes from the Personal Responsibility Education Program, funded under the Affordable Care Act and administered by the Administration for Children and Families. Of this amount, $45 million was awarded as formula grants to the 46 states (including D.C.) and territories that applied for funding.

Insurees who sign an affidavit verifying they have prepared an advance directive for end-of-life care will receive an additional 4-dollar a-month discount. Public hearings are planned to start next month.

Final Day To Register For General Election

KENTUCKY...
If Kentuckians want to participate in the upcoming general election on November 2, 2010, Monday is the final day to register to vote.
County Clerks’ offices throughout Kentucky will accept voter registration cards until the close of business. A postmark of October 4 is also required for all mail-in voter registration applications. Registration cards can be obtained over the internet at www.vote.ky.gov/register.
Additionally, Secretary of State Grayson reminded voters that if they have moved recently, they need to update their voter registration so that they are allowed to vote on election day. In particular, if a voter has moved from one county to another prior to the voter registration books closing and he or she does not update his or her voter registration, that voter will not be allowed to vote in the general election.
Mayking Bridge Detour

KENTUCKY...
On Monday, state contractors will resume work on the US 119 bridge at Mayking. The bridge will be reduced to one lane, with a concrete barrier wall and temporary traffic signals, until some time in January. In addition, a section of KY3410, which runs underneath the bridge, will be closed during the same time.
What started as a routine bridge deck overlay has changed to a complete
superstructure replacement. When state inspectors analyzed the Mayking bridge deck after asphalt was removed, they discovered that deterioration of the structure was much worse than it appeared when the deck overlay was approved.
At the same time, KY 3410, which runs under the bridge will also be closed. Motorists can take a short detour on KY 1862, which can be used as an alternate route from either end.
KY To Get Additional Funding To Help With Housing Concerns

KENTUCKY...
Gov. Steve Beshear, along with Kentucky Housing Corporation (KHC) Chief Executive Officer Richard L. McQuady, announced that Kentucky will receive additional funding from the U.S. Treasury Department to help unemployed and underemployed homeowners pay their mortgages as they seek work. Kentucky originally expected to receive $55.6million, but received notification that the state will receive an additional $93.3 million for a total of $148.9 million.
“Kentucky’s unemployment rate continues to be at very high levels and we know we have families in need,” said Gov. Beshear. “This additional funding is much needed and means we will be able to assist even more Kentuckians.”
Geared to serve low-to-moderate-income households, this loan program is funded through Troubled Asset Relief Program (TARP) funds are dedicated to the expansion of the Housing Finance Agency Innovation Fund for the Hardest-Hit Housing Markets (the Hardest-Hit Fund.
Details are still being determined, but it is anticipated that the program will be launched statewide in April 2011. Until these funds are made available, Kentuckians who are facing foreclosure or near facing foreclosure can seek free help through the Kentucky Homeownership Protection Center.
Tennessee Governor Signs Order To Protect Ridgelines Adjoining KY
KENTUCKY...
Governor Phil Bredesen of Tennessee has signed a petition to protect ridge lines on the Northern Cumberland Plateau.
The petition signed Friday requests the U.S. Department of Interior, Office of Surface Mining to find ridge lines on land managed for public use on the plateau unsuitable for coal surface mining.
Much of the property covered by the petition is part of the state's 2007 "Connecting the Cumberlands" conservation initiative and is located in Anderson, Campbell, Morgan and Scott counties.
The Southern Environmental Law Center and the National Parks Conservation Association applauded Bredesen's signing.

Approved Mosque In Mayfield Under Reconsideration

A western Kentucky city's zoning board plans to discuss its rejection of a Somali man's request to build a mosque.
The Mayfield Board of Zoning Adjustments will meet Oct. 12, but will not take public comments. City Planner Brad Rodgers told The Courier-Journal in Louisville that the board will discuss a Sept. 22 letter from the American Civil Liberties Union on behalf of the mosque applicant, Khadar Ahmed.
The board denied a permit on Aug. 24, reversing a decision made two weeks earlier to approve it, citing concerns about limited parking and capacity in the small commercial building where the mosque was planned.
The board and other city officials heard opposition to the proposal from critics of Islam at the hearing and in correspondence.
Ahmed sought to build the mosque for Somalis who moved to Graves County to work in a chicken processing plant.
