Pike County Fiscal Court Faces Revenue Shortfall

KENTUCKY....
The Pike County Fiscal Court heard it first reading of the proposed budget for FY 2010-2011 during its regular meeting on June 1. Facing a multi-million dollar shortfall because of decreased coal severance and minerals taxes, Judge-Executive Wayne T. Rutherford and the rest of the fiscal court have been working diligently to make sure no jobs are cut, no taxes increased and no change in health insurance coverage. This year’s budget of $35.5 million is down from $40.3 million a year ago and cuts have been made to ensure a balanced budget is submitted to the state for approval, which is required by law. Rutherford said the opening of five new mining operations around the county will be a boom to our economy, creating jobs and increasing coal severance funds. To combat the shortfall, salaries have been frozen and cost of living raises suspended. The magistrates voluntarily gave up their cost of living raises, and although Judge Rutherford offered to take a 5 percent pay cut, he was told by Pike County Treasurer Johnda Billiter he could not take a voluntary pay cut because his salary is state mandated. Overtime has been cut out and the purchase of new vehicles and equipment has been suspended. Travel has been limited to only the elected officials, directors and commissioners when necessary. More cost-cutting came from the Mountain Pub-Links Golf Course, which will have to pay its own way this year, and the Commonwealth’s Attorney budget was decreased by $18,000. Constables’ travel reimbursements have been cut to $600 a month from $1,000 a month, but they will no longer have their duties in regard to solid waste. One contracted position has been eliminated. Rutherford said by the third quarter of this fiscal year the county’s budget makers should be able to get a good idea of what Fiscal Year 2011-2012’s budget will look like.
Stanton Man Arrested On Sex Charges
KENTUCKY....
Jerry D. Rogers Sr., age 47, of Stanton was arrested by Kentucky State Police Electronic Crimes Branch as a result of a joint undercover operation with the Lexington Police Department. Rogers traveled to Winchester in order to meet an adult female accompanied by two underage girls, ages 8 and 10 years old,to engage in sexual activity with the children. Rogers was charged with unlawful use of electronic means to induce a minor to engage in sexual activities. He was lodged in the Clark County Detention Center on $10,000 bond. The investigation is continuing.

Highway Fatality Report

Preliminary statistics indicate that eleven people died in nine separate crashes on Kentucky roadways from Tuesday, June 1, through Sunday, June 6, 2010. None of the fatalities occured in the EKB listening area. A triple-fatality motor vehicle crash occurred in Madison County. One fatal ATV involved crash occurred in Greenup County. The victim was not wearing a helmet. One pedestrian involved fatal crash occurred in Whitley County and involved the suspected use of alcohol. Through June 6 preliminary statistics* indicate that 267 people have lost their lives on Kentucky roadways during 2010. This is 68 less fatalities than reported for the same time period in 2009.

EQT Science And Math Day Camp
KENTUCKY....
Applications are now available for EQT’s annual Science and Math Day Camp at Pikeville College. Registration is open to students who will be enrolled in the fifth through the eighth grade in the upcoming 2010-2011 school year. The camp is open to students entering the fifth and sixth grades the week of July 5-9, and open to students entering the seventh and eighth grades the week of July 12-16. The activities each week generally run from 8:30 a.m. to 3:30 p.m. daily, with the exception of check-in on the first day and a daylong Friday field trip. Interim President At Hazard Community College

An interim president for Hazard Community and Technical College has been named. Michael B. McCall, president of Kentucky Community and Technical College System, announced Dr. Kristin T. Williams will take over the college on an interim basis on July 6. Since 2007, Dr. Williams has served as the chief academic officer at Hopkinsville Community College (HCC), where she is responsible for the overall operations of the academic side of the institution. Dr. Williams’ previous experience at HCC will help her blend seamlessly into the educational structure of HCTC. McCall’s announcement comes weeks after HCTC’s outgoing president, Dr. Allen Goben, made his own announcement that he had accepted the presidency at Heartland Community College in Illinois. Goben began his tenure at HCTC in the summer of 2007.

Man Dead...Wife Wounded In Boone County

A husband was found dead and a wife injured in a double shooting at a northern Kentucky home, but police say they aren't pursuing suspects outside of the house. 54-year-old Donald Sassin suffered a single gunshot wound and was pronounced dead Saturday evening at St. Elizabeth's Hospital in Florence. The Boone County Sheriff's Office says 52-year-old Pamela Sassin was shot once and was taken to University Hospital. Police said the couple was alone in the house and they weren't looking for any other suspects. Sheriff's department spokesman Tom Scheben says Pamela Sassin called a relative after being shot at 3:10 p.m. The relative then called 911. Scheben wouldn't say what investigators thought happened, but said no suspects were on the loose.

A government watchdog group says the Tennessee Valley Authority may have weakened the Environmental Protection Agency's position on regulating coal ash when it was allowed to speak on the issue before the public. An accidentally released internal federal document shows that the public power producer, still cleaning up from a massive coal ash spill in 2008, criticized EPA's original draft proposal. That proposal said coal ash should be classified as a "special" waste, making it fall under hazardous waste rules. Open government advocates OMB Watch say TVA had a direct conflict of interest. Barbara Martocci, a TVA spokeswoman, said it would have been irresponsible for TVA not to comment.

Thirty year old Karin Rush Blankenship, a Laurel County woman who worked as a nurse at St. Joseph-London and was 32 weeks pregnant, died of bacterial meningitis Sunday at the University of Kentucky Hospital. Doctors at St. Joseph-London performed an emergency C-section in which she gave birth to a boy and a girl who were sent to University of Kentucky Hospital by helicopter Saturday. Later Saturday Blankenship was transferred to UK Hospital where she died the following day.

The attorney for Corinne Schwab, a Jackson County teen accused of kidnapping a gay classmate, has filed a letter asking that Schwab be allowed to meet with Jackson County Attorney George T. Hays, or someone in his office, to swear out a private-party complaint against Cheyenne Williams. Schwab wants to file a complaint charging Williams with either first-degree perjury, a felony, or false swearing, a misdemeanor. Williams used the same action to file charges of attempted murder and kidnapping in April against Schwab and Ashley Sams, both 18, and a 17-year-old girl. If Schwab is not allowed to file charges through a private complaint, she may ask to testify to the grand jury.

Cumberland River Bridge Work

Work to rehabilitate the US 60 Cumberland River bridge in western Kentucky will slow traffic on the bridge beginning later this month. The Department of Transportation says truck traffic will be restricted on the Livingston County bridge, and at night only passenger vehicles will be allowed to use it. The restrictions will prevent trucks and farm equipment over 10 feet wide from crossing the bridge during the day.
Contractors will work around the clock to make sure the hardship placed on farmers and truckers will be short-lived. The work is tentatively scheduled to start June 14.

I-65 Gets Temporary Fix
KENTUCKY....
Kentucky transportation officials have put temporary concrete barriers in the median of Interstate 65 in Hart County. The barriers were installed following the deaths of 11 people on the highway in March. Ten people in a van and a tractor-trailer truck driver died when the truck ran through the median near Munfordville, hit the van, then crashed into a rock wall. Department of Highways spokesman Mark Brown said the new temporary barriers prevented a tractor-trailer from crossing through the median last week. He said the barriers will remain until a permanent fix is completed.

The teams followed the prescribed plan for re-entry and exploration, and, by 1:00 P.M., had examined the #5 set of seals and the #1 and #2 set of seals with no reported problems. The exploratory teams are attempting to make sure it's safe enough for investigators to start searching for the cause of the April 5th explosion.

Appalachian Power Reaches Settlement

During a hearing in Charleston Monday, Appalachian Power reached a settlement with a group of rate hike opponents which is expected to be approved by the Public Service Commission by June 30th. Under the hike, Appalachian Power's residential customer rates are expected to climb 7.4 percent next month. As part of the settlement, Appalachian agreed to scrap plans to offer a senior citizen discount... up to $60 a year for customers 65 and over. Appalachian says its $95.3 million rate hike was necessary to recoup the costs of coal, comply with environmental regulations and purchase power from other utilities. If the PSC approves the settlement, Appalachian Power's residential customers using 1,000 kilowatt-hours a month would see their monthly bills increase from $80.47 to $86.41, starting July 1st.

The Logan County Sheriff’s Office says the body of 37 year old Morris Goodman of Bruno was found in the Rich Creek area about 5:50 P.M. Sunday by a man riding his ATV on the old Belva Coal Company strip mine site. The rider told officers he saw two men standing by a truck about an hour before he found the body, but the truck was no longer at the site. Authorities say Goodman was electrocuted while trying to remove grounding cable from an Appalachian Power Company utility pole, causing his body to be severely burned.

Monday, investigators raided a home in Upper Pecks Run on the Upshur/Harrison County line and found anhydrous ammonia, other chemicals used to make meth, marijuana plants growing outside the house and individually packaged marijuana inside the home. Upshur County Sheriff’s deputies arrested two brothers, 26 year old Jesse Evan Howes and 30 year old Clinton Scott Howes, of Buckhannon and charged them with operating or attempting to operate a clandestine drug lab, manufacturing a controlled substance, and possession with intent to deliver a controlled substance. Clinton Howes was also charged with child neglect creating the risk of injury.

PSC Rejects Consumer Advocate Request

Monday, the West Virginia's Public Service Commission rejected a request filed by the agency's Consumer Advocate Division asking the commission to reconsider the sale of Verizon's landline phone service in the state to Frontier Communications while the consumer advocate sought an independent audit of the deal and other safeguards. The PSC says the division failed to present any new evidence justifying reconsideration in the $8.6 billion deal in which Verizon is selling 4.8 million landlines in 14 states to Frontier.

Union Workers End Red Cross Strike

Union workers staged a five-day strike at the Red Cross blood collection centers in Huntington, Charleston, and Parkersburg before agreeing to return to work at midnight Sunday. Union officials say the union members have been working at the locations for a year without a contract and they are having no luck getting Red Cross to hold bargaining discussions. In their dispute, union workers say, besides working conditions, pay scales, and benefits, there are bigger issues at play. Workers say they will continue pushing and hope someone will look into their claims and force Red Cross to make changes.
Beckley Woman Charged With Malicious Wounding
WEST VIRGINIA....
Twenty year old Jessica Jean Amick of Beckley has been charged with malicious wounding and grand larceny. Beckley Police say Amick and her boyfriend were guests at an apartment at 535 McCulloch Drive, and 18 year old Chelsea Dillenger had been staying overnight. When Amick left the apartment early Saturday morning, carrying a suitcase, the resident and Dillenger noticed several items missing. The women found Amick near the North Eisenhower Drive Food Lion’s parking lot. When Dillenger asked Amick about the stolen items, a physical altercation ensued, resulting in Dillenger being stabbed several times with what appeared to be a hunting knife.

Charleston police were dispatched late last week to the Foodland store on Spring Street to investigate a possible meth lab after store manager Sheila Burgess became suspicious when 38 year old Michael Scott Jones of Wyoming Street, walked into the woods behind the store after buying six bottles of iodine and one bottle of peroxide. Upon investigation, officers discovered Jones standing by a tree with a large blue tarp slung over its branches to create shelter while he was bent over, pouring a liquid into a canister. When officers got closer they noticed a plastic bag containing white powder, a peroxide bottle cut in half with a red liquid inside, and several other meth-making ingredients. Jones attempted to run, but, once handcuffed, he told officers he only breaks down the ingredients and prepares the meth lab for cooking, but does not do the actual cooking.

Milton Trial Rescheduled

Christopher Riddle of Milton was scheduled to be in court Monday, but the hearing was rescheduled for July 14th. The Cabell County Sheriff'f office charged Riddle with wanton endangerment after his 12 year old daughter was found shot in the neck while outside their home on Dry Ridge Road on May 21st. Investigators believe the shooting was accidental.

A nine-mile connector system linking the Pinnacle Creek and Indian Ridge trail systems is expected to be completed by the end of June. The new system also will connect the Hatfield McCoy Trails to Twin Falls State Park and the towns of Northfork, Keystone, Ashland, Pineville and Mullens. Another trail system in Mercer County will be connected when it opens in the fall, and plans to build a visitors center in Mercer County have been made.

Saturday, and, while portraying themselves as city workers, told the woman that city workers would start cutting trees on her property on Monday free of charge. One of the men led the woman away from her house to point out which trees needed to be cut while police say the other stole money from her home.

Marshall County officials say a gas well owned by Chief Oil and Gas Wells caught fire around 1:30 A.M. Monday morning on Beam's Lane just off Route 250 between Limestone and Moundsville, injuring seven workers and changing the route for Marshall County school buses. Three people were taken by ambulance to Pittsburgh hospitals after fog grounded helicopter flights. The other four injured were transported to local hospitals.

State Corrections Employee Faces Drug Charge

Kentucky State Police confirmed Friday that 58 year old Billy Finley of Kuttawa, a corrections employee at the Kentucky State Penitentiary in Eddyville was found with Xanax and Lortab prescription pills when officers conducted a random search of employees during a shift change while he was on duty last week. He was arrested and lodged at the Caldwell County Detention Center after being charged with promoting contraband. Finley has worked at the state prison for five years. The investigation was conducted by State Police Detective Brett Miller.

Disaster Exercise In Pike County

The Pike County Office of Emergency Management, in conjunction with local and regional disaster response organizations and police and fire departments, participated in a Full Scale Hazardous Materials Mass Casualty Disaster Exercise on Saturday. It took place on the new section of US460 on Little Creek. The exercise began at 9:30 A.M. and lasted most of the day. The cooperation of Highway District 12 was a significant contributor to the exercise. This was a full-scale exercise where teams of responders took part in a variety of disaster scenarios. The latest techniques and equipment were used as individuals and departments sharpened their skills in responding to many types of disasters...natural and man-made. Doug Tackett, Director of the Pike County Office of Emergency Management said this was one of the largest simulation and training events held in eastern Kentucky.

Black Bear Killed In Letcher County
KENTUCKY....
A black bear killed by wildlife officials in eastern Kentucky last weekend had broken into a home at Linefork in Letcher County. State wildlife biologist Steven Dobey said the young male bear had become "a public safety issue" after it "went way over the line." No one was home when the bear broke in, ripping down curtains breaking windows, destroying furniture and tearing a hole in the roof. Kentucky Department of Fish and Wildlife Resources spokeswoman Mark Marraccini said officers kill about four bears a year in Kentucky because of irregular behavior.

The General Assembly finalized a two-year budget and road plan over the weekend that will see Floyd County receive $66 million in funding for various projects. Most of the money, $62.6 million, will be used for road projects such as the continued efforts on the Minnie-Harold connector, which will alone make up $40 million of that amount, said House Speaker Greg Stumbo who has been part of that project since its beginning several years ago. Some $3.21 million of the funding will be used for a variety of coal-severance tax projects and yet remaining amounts will be used on projects in the southern end of the county. Included was more than $40 million for the Minnie-Harold connector and helped Wheelwright with its gym and swimming pool. funding will also go to scholarships to the Highlands Center for Autism to help families cover tuittion costs. More charity golf touraments are also in the works for the center, Stumbo said, in order to bring the total of school or personal donations to $100,000 a year.

A northern Kentucky woman convicted of marrying an impaired man a quarter-century her senior to steal his money won't go to prison. Cathleen Kenter-Nevins was sentenced Thursday in Burlington to six years on each of three counts of exploiting an adult. She was convicted in March in Boone Circuit Court. The sentences are to run concurrently, but were suspended and Kenter-Nevins was placed on probation for five years. She must pay $138,213 in restitution. Authorities contend Kenter-Nevins befriended Danny Nevins to steal from his $1 million trust. When Nevins died in March 2008, Kenter-Nevins claimed to be the sole heir to his estate.

On Friday Kentucky State Police in Hazard received a 911 call cpmcerning a male subject found in his home deceased in the Guage community of Breathitt County. The caller stated it appeared that the victim had been shot. Preliminary investigation indicates that Ralph Spencer, age 46 of Guage in Breathitt County had died from an apparent gunshot wound. Mr. Spencer was found after no one had heard from him that morning. The victim has been transported to the State Medical Examiners Office in

Beshear Gets Budget Legislation

Governor Steve Beshear took final action on legislation passed by the General Assembly during last week’s special session, which provided a biennial Executive Branch spending. “This budget passed by the General Assembly is not what I wanted, and not what I originally proposed,” Gov. Beshear said. “However, it is better than having to shut down state government, and I will work hard to minimize its impact on Kentucky families.” Gov. Beshear vetoed provisions in the budget bill passed by the General Assembly that would restrict his ability to implement the cuts required by it. “My administration must have maximum flexibility to manage state government through these extremely difficult times, while continuing to provide essential services to our people.”, the Governor said.

Stimulus Money Provides Training/Jobs

Kentucky Housing Corporation will receive almost $1 million in federal stimulus money to fund weatherization training. The organization will receive $996,000 from the U.S. Department of Energy to establish a new weatherization training center in Frankfort and to expand training programs. The project was one of 34 in 27 states that received a total of $29 million in funding. The projects are aimed at providing job training in energy-efficient weatherization.
New Arena In Louisville Books Eagles

The first event in a new downtown arena in Louisville built for basketball will be a rock concert by the Eagles. The Louisville Arena Authority says the Eagles are booked at the KFC Yum! Center on Oct. 16. Public tours of the facility will be offered Oct. 11-13 and a VIP event is set for Oct 14. The $238 million arena is to be the new home of the University of Louisville men's and women's basketball teams. Both teams will play their first games there in November.

30-Year-Old Rape Conviction Thrown Out
KENTUCKY....
A Jefferson County judge has thrown out a 30-year-old rape conviction against Michael VonAllmen, ruling there was clearly enough evidence to exonerate him. Judge Charles Cunningham found evidence presented by VonAllmen's attorney that the actual rapist was likely Ronald Tackett convincing enough to throw out the conviction. VonAllmen served 11 years for the 1981 rape of a 22-year-old woman and was paroled in 1994. Tackett died in a car crash while fleeing police in 1983. While the verdict has been dismissed, the 57-year-old VonAllmen technically still faces charges and prosecutors must now decide whether to put him on trial again. The victim said through her attorney she still believes VonAllmen raped her.

More than 150 Coal Field Riders spent Saturday morning in McDowell County where they gathered and enjoyed breakfast before hitting the road on their way down Route 3 in Montcoal as part of a two-plus hour trek, "A Ride for 29" from War to the Marsh Fork Worship Center. The next stop took them to Eunice where they held a memorial service for the fallen miners of the Upper Big Branch Mine disaster. The service involved the reading of each miner’s name, followed by 29 chimes from the church’s bell, and afterward a moment of silence was held. Riders donned their bikes once again and made their way back to McDowell County for a concert in which proceeds will go towards the Coal Field Riders who plan on donating that money to the families affected by the mine explosion.

Deputies say he became acquainted with the family of a 13 year old female and then engaged in sexual intercourse with the girl in May while at a residence near St. Albans. Spangler is free on $5,000 personal recognizance bond and is scheduled for a preliminary hearing on June 10th after being charged with third-degree sexual assault.

According to the FAA, a four-seat Cessna 182-P Skylane aircraft registered to Sky King Aviation of Wilmington, Delaware crashed a short distance from Rainelle Airport's 3,300-foot grass runway atop Sewell Mountain shortly before noon Friday. Officials say the plane went into some trees at the end of the runway. Three aboard the plane, Rodney Ouzt, Roger Peace and J.T. Little were taken to Greenbrier Valley Hospital, and the pilot, Verone Peace, was flown by helicopter to Charleston Area Medical Center General Hospital. All four men are from Greenwood in Pickens County, South Carolina. They had taken off from the Cleveland area Friday morning en route to Rainelle, but crashed just short of the runway.

Students across West Virginia are bound for some fun in the sun as they begin summer break this week. However, the school year ends without a single school district having provided the state's mandated 180 days of instruction for the 2009-10 school year. Schools in Kanawha County finished closest to the target with 178 instructional days. In Cabell County, students will get 177 days of instruction, making up for some lost time by eliminating outside school environment days. Weeks of bad weather and rigid rules regarding how snow days may be made up have school officials searching for a solution. Some schools already provide the option of getting more instruction by adding an hour-long afterschool program. The West Virginia Education Association says their voice is being heard and they are working with elected officials to improve education. A special session on education will be held on July 19th when legislators hold the July interims.

Former NASA investigator now Texas lawyer Joe Gutheinz Jr has challenged his graduate students since 2002 to locate missing moon rocks collected during Apollo 11 and 17 missions and presented to the 50 states and several counties as goodwill gifts. But, based on the description retired Morgantown dentist Robert Conner gave him Friday, Gutheinz is convinced Conner has a real moon fragment in his possession left by his deceased brother. Gutheinz believes the one-gram rock fragment encased in plastic and resting on a wooden plaque that also holds a miniature West Virginia state flag that flew on the Apollo 17 mission was actually presented to the state by NASA during the 1970s. Conner says former Governor Arch A. Moore Jr., who was presented the fragment while in office, and was once affiliated with his brother Troy’s Washington, D.C., law firm, may have given it to his late brother to observe while Moore's intent was for the fragment to end up at the West Virginia University library.

Wess Harris, an author and state Labor History Association board member who was named last year's "West Virginia History Hero'' objects to the exhibits as the museum prepares to celebrate its first anniversary on West Virginia Day, June 20th. Harris alleges the nearly $18 million exhibits contain several errors, putting Harris at odds with the state Division of Culture and History, which oversees the museum and has dismissed the questions he's raised about the displays. Harris says the visual content is good, and it's a wonderful presentation, but a few things need to be changed...an opinion not shared by the state Division of Culture and History.

Verizon and Frontier are urging the state Public Service Commission to reject the state Consumer Advocate Division's petition to reconsider a May 13th order that paves the way for the sale of Verizon's telephone landlines to Frontier Communications in West Virginia. Verizon and Frontier say they've already agreed to "28 pages of commitments and stipulations" in the PSC's order approving the transaction, and the PSC should deny the CAD's petition and affirm its decision. Ten days after the PSC approved the sale, the consumer advocate asked the commission to order an independent audit of Verizon's plans to switch over its operations system to Frontier. It has also urged the PSC to impose additional safeguards so that Verizon customers wouldn't have to pay early termination fees for "bundled" services provided by Verizon partners, such as DirecTV. Verizon and Frontier responded that the commission already has ordered Verizon to notify customers of the pending sale and waive any early termination fees for 90 days after the deal closes.

In December, the bank had claimed that the church owed more than $702,000 on a $900,000 loan taken out in 2001, plus nearly $37,000 in interest, and that Mark Manuel of Tennessee had helped the church file fraudulent documents related to the loan. Fifth Third Bank also had sued Manuel and his company, DigiGreeters, as well as church trustees and elders. According to the church's legal filings, in June 2009, Manuel presented the church with documents showing that the entire loan had been paid.

West Virginia Man Missing In Maryland State Forest

Seventy-two year old James Lewis Alt of Piedmont, West Virginia was reported missing Saturday after he and some friends went ginseng hunting in the Savage River State Forest in Maryland. The group separated about 11:00 A.M. Saturday morning with plans to rendezvous at their vehicle around 4:00 P.M., but Alt failed to show up. He was reported missing around 8:00 P.M. Maryland Natural Resource officials and other rescuers have been searching for Alt while using both K-9 and horseback units. Alt is a white male, stands about six feet tall, weighs around 170 pounds, and was last seen wearing a baseball cap, blue shirt and blue jeans.
Seventy-two year old James Lewis Alt of Piedmont, West Virginia was reported missing Saturday after he and some friends went ginseng hunting in the Savage River State Forest in Maryland. The group separated about 11:00 A.M. Saturday morning with plans to rendezvous at their vehicle around 4:00 P.M., but Alt failed to show up. He was reported missing around 8:00 P.M. Maryland Natural Resource officials and other rescuers have been searching for Alt while using both K-9 and horseback units. Alt is a white male, stands about six feet tall, weighs around 170 pounds, and was last seen wearing a baseball cap, blue shirt and blue jeans.

Fifty-six year old Debra Dawn Tagnesi of South Charleston was arrested last week and charged with a felony count of malicious wounding. South Charleston Police say, when they arrived at 403 Mount Shadow Road, they found Joe Tagnesi lying in the yard outside his home with a gunshot wound to the arm. Tagnesi told police his wife had shot him with a .38 caliber handgun. He was taken to Charleston Area Medical Center General Hospital. Debra Tagnesi was placed on a $10,000 bond.

Mingo County Sheriff’s Deputies say they believe Samantha Sue Evans was under the influence of drugs when she left her 16-month-old daughter unattended in a bathtub of scalding hot water, causing the girl to suffer severe burn injuries to her legs. She died at Williamson Memorial Hospital late Thursday night. The Sheriff’s Department was conducting a drug raid at a house next door in the Jennies Creek area about 9:30 P.M. Thursday night when someone came to the house they were raiding and asked for assistance with the infant. Evans is charged with felony child neglect resulting in death and possession of a controlled substance.

After winning $100,000 on the Kentucky Derby, Jerry Tucker, the owner of Foglesong-Tucker Funeral Home in Mason County, West Virginia might end up going to jail. Jerry Tucker, the mayor of Mason, and his brother, Ray Tucker, the funeral home's vice president, failed to pay the West Virginia Attorney General's Office any of the $150,000 reportedly stolen from clients who had pre-paid for funerals. The brothers missed Thursday's deadline to make a $140,000 down payment on the $175,000 they agreed to pay. The Tuckers could have faced automatic triple damages, which would have pushed the amount to more than $600,000.

According to court documents, Mills and his business partner, 43 year old Rodney T. Hoffman, also of Beckley, stored hazardous waste in open containers and vats at Mills Plating without obtaining a permit. The state Department of Environmental Protection discovered the waste in February 2007. Hoffman pleaded guilty in April and is scheduled to be sentenced August 18th. Mills faces up to five years in prison and a $50,000 fine per day of violation when sentenced September 22nd.

In exchange, the company wants to organize a joint committee consisting of labor and management in order to find ways to improve operations and efficiency at the plant. If approved, the contract will be in place for the next two years.

Teens Plead Guilty To Murder

Jimmy Thompson and Michael Thompson, both 19 years old, are both facing life in prison and will be sentenced once a mental evaluation is complete. Friday morning, they both pleaded guilty to first degree murder in connection to the November 2009 fatal stabbing of 51 year old James Gillespie of South Charleston. Police say the teens were drinking beer and getting high with Gillespie while at his home, when another teenager stole his pills. Gillespie realized they were gone, and got angry. That's when they say they kicked, strangled, stabbed him and stole other items from him.

To avoid the 20 day furloughs, Huntington Mayor Kim Wolfe has announced a new four day work week for city employees aimed at saving the city $425,000 a year. Wolfe says, effective July 5th, employees will work from 7:00 A.M. to 6:00 P.M. Monday through Thursday, with City Hall being closed on Friday. The plan also includes 10 percent reduction in pay and elimination of seven city jobs.

He remove language from the $17 billion state budget that would have slashed the $250,000 a year salary of Economic Development Secretary Larry Hayes by about half and eliminated $445,000 in appropriations for two road projects. While the governor said the budget was neither what he wanted nor what he proposed, he said it is better than having a shutdown in government services. Lawmakers do not have the ability to override Beshear’s vetoes since the General Assembly adjourned its special legislative session to approve the budget on May 29th.

Pike County Central Students Win State Competition
Pike County Judge-Executive Wayne T. Rutherford gave a taped interview to Lakin Mills and Emily Hunt, who are members of the Pike County Central High School History Day Team. The team won its sixth consecutive state competition with its documentary showcasing the Pikeville cut-thru project. Rutherford recounted his involvement with the project and former Pikeville Mayor Dr. William Hambley. The team is currently accepting donations to pay for a trip to the national competition at the University of Maryland June 13-17. Currently $800 short of the $3,500 goal, donations can be made by calling Gina Ray, winner of the 2010 National History Day Patricia Behring Kentucky Teacher of the Year, at 432-4352. The cooperation of Highway District 12 was a significant contributor to the exercise. This was a full-scale exercise where teams of responders took part in a variety of disaster scenarios. The latest techniques and equipment were used as individuals and departments sharpened their skills in responding to many types of disasters...natural and man-made. Doug Tackett, Director of the Pike County Office of Emergency Management said this was one of the largest simulation and training events held in eastern Kentucky.

Randy Madan, a retired associate warden at the Big Sandy federal prison in Martin County, said problems at the four-county regional jail include security, safety, cleanliness and financial issues. Suspended jail administrator Henry "Butch" Williams, 54, of Oil Springs in Johnson County, who is charged with accepting a bribe from an inmate, pleaded not guilty at his arraignment Friday. Police said Williams accepted a Ford F-150 pickup in January 2009 from an inmate in exchange for having the inmate's wife transferred to Big Sandy from another jail. Madan was hired last month to replace Williams, who is under orders to stay away from the jail until his trial is complete. Madan said he would be presenting at least 15 problem items — with a price tag of about $500,000 — to the Regional Jail Authority, which includes Johnson, Martin, Magoffin and Lawrence counties. The board meets June 17.

A Breathitt County man was found dead of a gunshot wound Friday. Kentucky State Police said Ralph Spencer, 46, of Guage was found by family after he hadn't been heard from in the morning. An autopsy is being conducted. As an investigation is initiated, at this time no arrests have been made.

Marion County Prosecutor To Handle Police Case

Marion County Prosecutor Pat Wilson will handle the case of Shinnston police officer 30 year old David Matheny of Grafton who's accused of felony counterfeiting for allegedly using a fake $100 bill at a gas station in April. Matheny told police he didn’t know the bill was fake, but a criminal complaint says the serial number matched one from a counterfeit bill Matheny had recovered from a Shinnston business while on duty. Harrison County Prosecutor Joe Shaffer stepped aside because Matheny was the arresting officer in cases pending in his office. Matheny, also a member of the Harrison County Street Crimes and Drug Unit, has been suspended with pay and faces two to 10 years in prison if convicted.

After being asked by legislative leaders, Governor Joe Manchin has delayed the special legislative session on education reform until July 19th. The legislative group believes that, by working during the June interims, their work on all of the bills can be completed by June 11th. They say delaying the restart of the special session until July 19th will allow all lawmakers and the general public to review the bills before lawmakers vote. July 19th will be in conjunction with the legislature's July interim committee meetings.

The estate of Joe Porter has filed a civil rights lawsuit against the city of Huntington and Police Officer Ronnie Lusk who fatally shot Porter when he and fellow officers responded to an exchange of gunfire outside Club Babylon on 4th Avenue on Nov. 8, 2009. The lawsuit alleges Lusk turned his weapon on Porter without provocation and for no apparent reason. However, a police investigation found Lusk justifiably fired in response to Porter pointing a .45 caliber handgun toward him. The lawsuit charges police failed to seek timely medical treatment, leaving Porter bleeding on the floor while officers restrained, threatened and/or intimidated witnesses. The Police Department says officers handcuffed Porter as a precaution, and an ambulance crew arrived at the bar at 3:14 A.M., 8 minutes and 27 seconds following the initial report. The ambulance arrived at the hospital at 3:33 A.M. Huntington Police Chief Skip Holbrook relied upon his department's investigation and last month's grand jury decision to exonerate Lusk, saying he was certain there was no wrongdoing on the city's part, and the department will absolutely defend itself.

Twelve people died while boating in 2009, including four who were whitewater rafting, but none of the deaths were attributed to intoxicated drivers. Lt. Tim Coleman with the state Division of Natural Resources says, in an effort to catch drunken boaters, conservation officers will be stepping up patrols on West Virginia waterways this summer. All of the state's 112 conservation officers received training in April on how to spot drunken boaters. Coleman says only seven people have been cited for operating a boat while intoxicated in the past three years while authorities haven't done a very good job tracking down drunken boaters...leaving boating under the influence a major problem in the state. It's OK to have a case of beer on the side of a boat, but the operator can't be drinking. The process for screening drivers is similar to how it's done on the highway, with officers using breathalyzers to analyze blood-alcohol content and anything .08 and above is illegal. Areas targeted for increased enforcement include Summersville Lake, the Ohio River in Parkersburg, Wheeling and Huntington and the Kanawha River through Charleston...with Summersville Lake considered the biggest problem area.

State Auditor To Conduct Independent Exam

The state auditor's office will conduct an independent exam after a controversy involving fraud allegations by a city employee in Lexington. Auditor Crit Luallen said in a statement the review would analyze "the procurement process for the city's insurance services" and the handling of fraud allegations made by a city employee.
She says the move comes after media coverage, information provided to her office and a request by Lexington's internal auditor. Patrick Johnston made fraud allegations in 2008 and 2009, which were dismissed as being without merit. City council members have questioned whether the allegations are related to a proposed elimination of Johnston's job in a reorganization.

Facebook is almost an addiction for many. Now law enforcement agencies are getting hooked. Kentucky State Police use the social networking site as a way for you to get to know them and stay informed. "We are on the right track with the social media and we're gonna continue to use it," said Lt. David Jude. KSP started their Facebook page a year ago and already have 17,000 followers. By "liking" the page, you can follow what they're working on. The page can warn you about everything from a missing person to an escaped inmate. Jude says the site allows them to instantly put out information to a wide audience quickly and it also get's them instant feedback.

Three Highway Fatalities In Madison Co.

Richmond Police say three people were killed and four injured in a collision between a car and pickup truck Thursday. The car pulled in front of the pickup on Irvine Road, near Richmond's bypass. The truck slammed into the car. Police say 56-year-old Wilma Cox of Irvine, 48-year-old Gregory Hayes of McKee and an unidentified 7-year-old child were killed in the crash. All three were in the car. Four others were taken to University of Kentucky Hospital for treatment.

Injured Construction Workers Remain Hospitalized

Occupational Safety and Health Administration officials were in Phelps Thursday to investigate the collapse of a building which injured Lowell Thomas, Ronnie Thomas, Russell Sprouse, and Henry Brandell, workers with Thomas Roofing and Construction. Pike County Media Relations liaison Brandon Roberts says Ronnie Thomas and Brandell were treated and released at Pikeville Medical Center while Lowell Thomas and Sprouse were taken to Holsten Valley Hospital in Tennessee. According to Roberts, Sprouse is in the Intensive Care Unit with head and internal injuries, but Lowell Thomas may be able to leave the hospital as early as Friday.

Kentucky’s tax amnesty under Governor Paul Patton in 2002 was open to all delinquent taxpayers and raised more than $100 million. The state now expects to collect $15.5 million in taxes as a result of a limited amnesty. Under the revenue bill passed last Friday by the General Assembly, about 2,000 delinquent Kentucky taxpayers, mostly businesses, will get a break. House Bill 2 will erase millions of dollars in penalties, interest and fees owed by the delinquent taxpayers if they had a protest pending at the Revenue Department by January 19th of this year and if they agree to pay the original sum of taxes they owed no later than July 31st. The state currently charges 10 percent interest on delinquent taxes, with various penalties and fees ranging from 2 to 50 percent of the total owed.

MSHA issued four citations this week saying Bledsoe Coal Co. was negligent before a fatal collapse in January killed 29 year old Travis Glenn Brock of Helton who was operating a continuous-miner in the Abner Branch Mine in Leslie County when the corner of a pillar collapsed, resulting in a nine-ton piece of rock crushing him. A MSHA report states Bledsoe and its parent company, James River Coal, failed to conduct adequate pre-shift and on-shift examinations and ignored the hazardous rib conditions. The company also failed to modify its roof-control plan to address changing geological conditions in the mine. Three citations were issued for "unwarrantable failure," the most serious type of citation. According to MSHA records, the Abner Branch Mine has been assessed more than $160,000 in fines for five similar citations in 2010 and is contesting some of those fines.

Rutherford, President of the reunion. This will be the 14th annual homecoming for the Shelby Railroad Association, and it promises to offer much of the same from prior, successful reunions. Railroad Reunion historian Myra Adkins Coleman, who died less than a year ago, will be honored during the event.

Non-Registration By Sex Offender Nets Sentence

An Indiana man has received the maximum sentence allowed for failing to register as a sex offender. The U.S. attorney's office in Lexington announced Wednesday that 38-year-old Michael Wayne Henderson of Tell City, Ind., was sentenced to 10 years in prison Tuesday. Prosecutors say it's the longest sentence to be imposed in the Eastern District of Kentucky for the crime of failing to register. U.S. District Judge Joseph M. Hood also sentenced Henderson to a lifetime of supervised release. Henderson was convicted March 2 on the sex offender charge. He was convicted in Indiana in 2002 of the rape of a family member and sentenced to 10 years in prison. The U.S. attorney's office says he was paroled Sept. 22, 2008, and disappeared without registering.

U.S. District Judge Karen Caldwell also ordered 35-year-old Anthony Estep, a former sergeant and supervisor, to a year in prison and a year of supervised release. Both men pleaded guilty a year ago, and Tyree testified against two co-defendants who were convicted three weeks ago. Tyree pleaded guilty to conspiring to deprive detainees of their constitutional rights by physically abusing them and by writing false and misleading incident reports to conceal the abuse. Estep pleaded guilty to a civil right charge for failing to intervene and to obstruction of justice. Another defendant was sentenced last fall to a year in prison after pleading guilty.

Three men working on the Wolf Creek Dam rehabilitation project on Lake Cumberland suffered serious burns in an accident Wednesday afternoon. Officials say the three men were injured when a pressurized pipe came loose and sprayed them with hot slurry. Two men were flown to UK Hospital with what officials called "critical burns". EMS transported the third worker to Russell County Hospital. The resident engineer at the dam said all three men were treated and released. Officials say they don't know what caused the pipe to come lose. They continue to investigate.

Georgetown police say they found a 27-year-old woman lying in the middle of the road behind the Winnder's Circle Motel early Thursday morning. She told them she has no idea how she got there. She told officers that she only remembers hearing loud music and waking up with a pain in her back. The woman's dad showed up at the scene. He told authorities her name is Amanda Coots. EMS transported Coots to UK Hospital to be checked out. Police continue to investigate.

Belfry Volunteer Fire Department Chief Nee Jackson said his department was called out five times between Friday and Sunday evening. The first call came Friday, May 28, about an outbuilding on the property of Donna Dotson. That structure was a complete loss,
They were called again early Saturday morning, May 29, when the shed rekindled, and again Saturday evening when a fire threatened Dotson’s home and a vacant house adjacent to her home. The vacant house belongs to Delores Hatfield. An arson investigator with the Kentucky State Police, said the front porch of the vacant house and the side of Dotson’s home sustained damage from that blaze. The BVFD was called to the area again Monday, May 31 to fight a fire at the vacant house. The fire was contained to that building. An arson investigator said evidence left little doubt the fires were the result of arson.

Among the planned activities are bus tours of battlefields in Richmond, Perryville and Mills Springs. The Civil War Preservation Trust, based in Washington, D.C., is a nonprofit devoted to preserving endangered Civil War battlefields. It has provided more than $100,000 in matching funds toward the preservation of the Richmond Battlefield, and the Perryville Battlefield is on its "most endangered" list.

Raymond Jackson was charged with first-degree criminal abuse after his wife came home from work May 22 to find her 2-year-old daughter passed out. Doctors measured her blood-alcohol level at .259 and sent her on to Children's Hospital in Cincinnati. At a preliminary hearing for Jackson on Tuesday, Commonwealth's Attorney Rob Sanders said the former Marine is on probation for a misdemeanor child abuse conviction from Onslow County, NC for an incident last year. He remains in the Kenton County Jail.

The budget for inspections has increased at the same time the number of inspectors has shrunk from 90 in 2005 to 72 this spring. The newspaper reported the budget for inspections, which comes from state and federal sources, has grown from $5.4 million in 2005 to $6.7 million for the current fiscal year. Bernie Vonderheide, founder and president of the watchdog group Kentuckians for Nursing Home Reform, said the quality of care will suffer with fewer inspectors making rounds and Inspector General Mary Begley of the Cabinet for Health and Family Services said there are fewer inspectors and because of staff turnover.

The Kentucky State Police in Ashland are searching for 23 year old Zachary Riffe of Greenup, a fugitive wanted for sexual exploitation of a female minor. Riffe has been observed in the Whetstone Road and Crane Creek area of Greenup County. Building Collapses In Phelps

A building that was part of the fifth district county road garage near Smith Fork Road and Kentucky State Route 632 in the Phelps community of Pike County collapsed around 12:30 P.M. The Appalachian Regional Healthcare Board of Trustees has granted permission to enter the planning stage of expanding its facility in Hazard. The project will include fifty additional beds plus an expansion of the emergency department, making Hazard ARH one of the largest hospitals in the region. Kentucky State Police issued a warning Wednesday about a phone scam in which callers, claiming to be with state police or the Kentucky State Police Professional Association, are asking for money to benefit families of fallen troopers or to help buy drug dogs for schools. Lt. David Jude says these calls are not authorized by the Kentucky State Police and should be reported to the nearest state police post or the Kentucky State Police Professional Association at 502-875-1625 as soon as possible. A western Kentucky woman is in serious condition after being shot in a bizarre accident. 59-year-old Jerry Lampkin was floating down a Graves county creek in a raft, when he shot a 22 caliber rifle at a bird in a tree. The shot went through the trees and hit 49-year-old Mary Cherry, who was walking near the creek with her young granddaughter. The bullet lodged in her spine, and the victim's sister credits her granddaughter with saving Mary Cherry's life... adding her sister will be out and about soon. Cherry is recovering at the University of Louisville Hospital.

After rescuers pulled the family off the boat last Thursday, the vessel remained stranded on the dam while crews waited for lower water. When Travis Farley went to check on the vessel Tuesday afternoon, it was gone. The Farley's initially thought somebody had stolen the boat and reported it to the police. Turns out, the vessel was salvaged. Now the family will have to pay to get their boat back.

Basham and Chadrick Fulks, who had both been inmates in Hopkins County, had escaped from the jail in western Kentucky before killing the 44 year-old Donovan. Basham, who said his death sentence should be thrown out, made the appeal due to juror misconduct. The Supreme Court justices did not comment on why the appeal was turned down.

UMWA Concerned About Dotiki Mine

The United Mine Workers of America union is raising new concerns about the safety of a western Kentucky coal mine where two men were killed by a rock fall in April. UMWA Regional Vice President Steve Earle said non-union miners have been calling for increased scrutiny by government regulators since a second rock fall at the Dotiki mine on May 23. Alliance Resource Partners, the Tulsa, Okla., owns the company. The initial rock fall on April 28 killed 27-year-old Justin Travis and 28-year-old Michael Carter. No one was injured in the second rock fall that closed the mine for five days. The U.S. Mine Safety and Health Administration and the Office of Mine Safety and Licensing allowed the company to resume mining on May 28 after installing suplemental roof supports in the mine.

Kentucky State Police say Preston Ray Madison apparently entered the pool when he was left outside briefly at a family member's home on Saturday. The child's father found him at the bottom of the pool, and the boy was taken to Vanderbilt University Children's Hospital. The boy is survived by his parents, Jamie Madison and Whitney Crews. A 17-year-old drowned Sunday in a lake at La Grange, and officials say a 23-year-old Fort Knox soldier from Indiana remained missing after an outing at Taylorsville Lake and may have drowned.

Harrison is being charged with second degree murder. He claims the shooting was in self defense.

The attorney for former Williamsburg police officer Kenneth Bradley Nighbert, the son of former state Transportation Secretary Bill Nighbert, has filed a motion seeking a hearing for Nighbert to plead guilty after he and six others were charged with conspiring to sell pain pills from December 2005 to May 2007 while Nighbert was still a police officer. The federal indictment includes an allegation that Nighbert burglarized a pharmacy while he was a police officer in order to get pills.

Engineers from the Kentucky Transportation Cabinet have completed a study of a dangerous curve on U.S. 460 east of the Mouthcard Post Office. Several injury and fatal crashes have occurred in the curve, which caused Pike County Judge-Executive Wayne T, Rutherford and District 3 Magistrate Leo Murphy sent a letter to transportation cabinet secretary Mike Hancock in February of this year requesting the study. Murphy said he felt the road needed to be built up on the guardrail side, and Hancock addressed those thoughts in his letter, saying the curve may have geometric concerns. The curve has been the scene of several accidents and collisions, two of which have resulted in fatalities. The odd slant of the road also increases its level of danger. A field review of the curve – verifying the advisory curve speed and a review of the crash history – revealed the presence of an advance curve warning sign and a 40-mile per hour speed limit plaque in each direction along the curve. Damron stated the non-injury crashes were the result of drivers losing control of heir cars in the curve.

Now, tax parcel maps of Pike County are being converted into a seamless, countywide digital map that aligns with state and federal aerial photos as well as base data. “This technology enables a link between the property boundaries,” Pike County Judge-Executive Wayne T. Rutherford said. “This allows better coordination among all departments of the county and aids in road and bridge maintenance by making this information available to the Mountain Water District and Utility Management Group.” This technology also makes maps of the county available to mining and natural gas companies; the City of Pikeville can also access this system and it is being used by R.W. Armstrong, the Indianapolis-based company currently putting together Pike County’s Comprehensive Plan. The fiscal court, the 911 board and others approved this system and the county is now using it in many ways to protect our citizens and build our county government.

An ordinance was adopted by the Pike County Fiscal Court in December of 1993 requiring the owner, occupant or person in charge of a house, building, mobile home or other structure to display numbers on the structure’s exterior no less than three inches in size to aid in the location process. Not having numbers properly displayed poses a danger to the occupants. Pike County Judge-Executive Wayne T. Rutherford was also the judge when the ordinance was adopted in 1993, and he says his reasons for bringing this matter in front of the court nearly 17 years ago remains the same today. Preliminary statistics indicate that six people died in six separate crashes on Kentucky's roadways during the official Memorial Day holiday period, which began at 6:00 p.m. on Friday, May 28 and ended at 11:59 p.m. on Monday, May 31. Four of the fatalities involved motor vehicles and two of those were not wearing seat belts. The motor vehicle crashes occurred in Clark, Hopkins, Morgan, and Oldham counties. One crash involved a motorcycle in Rowan County and the victim was not wearing a helmet. An ATV fatal crash occurred in Breathitt County and the victim was not wearing a helmet. Two Floyd County residents have been indicted on charges of conspiring to distribute oxycodone and possession with the intent to distribute. Angelina Boyd, 31, of Grethel, and Keisha Howard, 20, of Hueysville, were indicted along with Procter Wayne Pennington Sr., 57, of Paintsville, Procter Wayne Pennington Jr., 38, of Paintsville, James R. Pennington, 52, of Flat Gap, Dean Wayne Wright, 38, of Oil Springs, and Sheena Spears, 22, of Paintsville. Pennington Sr. and Pennington Jr. also allegedly conspired to engage in money laundering. According to the indictment, on or about Feb. 5, Jan. 22 and Jan. 11, 2010, Pennington, Sr., Pennington, Jr., James Pennington, Wright, Boyd, Howard and Spears possessed with intent to distribute a quantity of pills containing oxycodone. Also according to the indictment, Pennington, Sr. and Spears distributed a quantity of pills containing oxycodone Dec. 19, 2009, Jan. 19, 2010, and Jan. 27, 2010. If convicted,all face a maximum prison sentence of 20 years.
Two Floyd County residents have been indicted on charges of conspiring to distribute oxycodone and possession with the intent to distribute. A two-year, $17.1 billion spending plan is heading to the governor’s desk following final legislative passage, staving off a potential shutdown of much of state government on July 1. The main difference between the two chambers, funding for the state’s schools most in need of replacement, was solved, clearing the way for passage. Under the final plan, the state will match funding for local school districts that levy a “second nickel,” or 5 cents per $100 in property value. The money would only be available for Category 5 schools, the facilities in the worst shape. The plan includes no new taxes and limits the amount of general fund bonding to around $437 million.

Softball Tourney Player Killed

A former Scott High School baseball and basketball player is dead ... murdered while at a softball tournament in Louisville over the weekend. Bryan Stevenson, 26, who had been living outside Toledo got into a fight at a restaurant early Sunday morning.
The assault happened outside Barbara Lee's Kitchen on lower Brownsboro Road. Police say the fight started inside the restaurant and spilled out into street. Another player on Stevenson's team was seriously injured. Police have charged four Louisville men with murder and assault. They are: Donald Hays, 30, David Pryor, 28, William Schindler, 23, and Justin Werner, 21.
